The MyData system, initially introduced in the financial, public, and healthcare sectors, is being expanded to all sectors from 2025 following the 2023 amendment to the Personal Information Protection Act. Despite the expansion of the system, however, MyData services in practice remain largely focused on simple ‘integrated information inquiry’ functions, resulting in limited perceived utility for users and, in some cases, the discontinuation of MyData services. Consequently, the MyData market has yet to achieve substantial activation. This study analyzes the causes of the stagnation in the development of MyData services from the perspective of data providers, rather than from that of existing service providers (data recipients), and proposes measures to address these structural limitations. Although data providers invest substantial costs and resources in collecting, processing, refining, and analyzing data, they face a loss of the first-mover advantage due to real-time data transmission obligations, as well as the burden of infrastructure investment and the risk of free-riding by late entrants. Consequently, data providers currently have insufficient incentives to actively participate in the MyData ecosystem. To address these issues and promote the revitalization of the MyData ecosystem, this study proposes, first, granting data providers a temporally limited exclusive right that allows them to recover the benefits of their investments in data for a certain period before such data are made broadly available in the market. Second, the current data transmission fee structure, which is largely limited to cost recovery, should be replaced with a fair and differentiated compensation mechanism that reflects the degree of data processing and the extent of the provider’s investment, together with a revenue-sharing mechanism based on the provision and utilization of data. By adopting a data-provider-oriented approach, this study seeks to encourage the active participation of data providers, thereby increasing the diversity and quality of data available within the MyData ecosystem. Ultimately, it aims to provide a legal and institutional foundation for establishing a virtuous cycle of sustainable development in the MyData ecosystem.

우리나라는 금융, 공공, 의료 분야를 시작으로 2023년 「개인정보 보호법」 개정을 통해 2025년부터 전 분야로 마이데이터 제도를 확대하고 있다. 그러나 제도 확산에도 불구하고 실제 서비스 현장에서는 단순 ‘통합조회’ 중심의 유사 서비스로 이용자의 체감 효용이 낮고 마이데이터 서비스를 종료하는 등 시장 활성화가 더딘 상황이다. 본 연구는 이러한 마이데이터 활성화의 정체 원인을 기존의 서비스(정보수신자) 측면이 아닌, 생태계의 핵심 축인 ‘정보전송자’ 측면에서 분석하고 해결책을 제시하고자 하였다. 정보전송자는 막대한 비용과 노력을 투자하여 데이터를 구축, 가공함에도 불구하고 실시간 전송 의무로 인해 선점효과를 상실하고 후발주자의 무임승차와 설비 투자비 부담에 직면해 있어 적극적인 참여 유인이 부재한 실정이다. 이를 해결하기 위한 마이데이터 활성화 방안으로 첫째, 정보전송자가 수집, 가공, 정제, 분석한 데이터에 대해 일정 기간 시장에서 우선적으로 투자 성과를 회수할 수 있도록 ‘한시적 배타적 관점의 권리’를 부여할 것을 제안한다. 둘째, 현행 원가보전 수준의 전송과금 수수료 구조를 탈피하여 데이터의 가공 정도와 기업의 투자 기여도를 반영한 ‘투자에 대한 정당한 차등 보상 구조’ 및 ‘데이터 제공에 따른 수익 배분 방식’을 마련해야 한다. 본 연구에서 주장하는 정보전송자 측면의 접근방법을 통해 정보전송자의 적극적 참여를 유도함으로써 데이터 제공의 다양성을 확보하고, 나아가 마이데이터 생태계의 선순환적 발전을 견인하는 기반을 제공하고자 한다.
