Legal and Ethical Issues of Oral History Records in the Age of Artificial Intelligence and the Reconstruction of Informed Consent
With the development of artificial intelligence (AI), the use of speech-to-text (STT) and generative AI technologies for transcribing, summarizing, and analyzing oral history records has rapidly increased. While AI-based tools offer new possibilities by reducing the time and labor required for oral history research, they also create new legal and ethical issues as interviewees’ voices and statements may be transmitted to and processed by external AI service platforms. This study examines these issues from the perspectives of the Personal Information Protection Act and the Copyright Act and analyzes the terms of service and privacy policies of CLOVA Note, Daglo, ChatGPT, Gemini, and Claude. Oral history records may contain not only identifying information but also voices, life experiences, family and social relationships, sensitive information, and personal information concerning third parties. The use of external AI services may therefore raise issues concerning the provision or processing of personal information, sensitive information, and cross-border data transfers. In addition, where an interviewee’s statements possess sufficient originality, copyright issues may arise in the reproduction and transmission involved in AI-based transcription and analysis. The comparison of AI services demonstrates significant differences in their policies concerning the use of input data for service improvement and AI training, third-party processing, cross-border transfers, data retention, and user controls. Accordingly, merely informing interviewees that “AI will be used” is insufficient; the specific service and its data-processing practices must be clearly explained. In particular, consent to the terms of service between a researcher and an AI provider must be distinguished from the interviewee’s consent to the processing of their voice and statements. The former cannot substitute for the latter. Based on these findings, this study argues that the conventional broad consent to “use for research and educational purposes” is insufficient in the AI era. Oral history release forms should distinguish between public disclosure and AI-based processing and provide specific information on the purpose and scope of AI use, service providers, the possibility of use for AI training or service improvement, third-party processing, cross-border transfers, and data retention and deletion. Consent to AI-based processing should also be separately selectable, with the scope and limitations of withdrawal clearly specified. The study concludes that AI should not simply be excluded from oral history research. Rather, the new structure of rights and responsibilities arising from AI-mediated processing should be transparently communicated to interviewees and incorporated into the consent process. Oral history release forms therefore need to evolve from documents governing whether records may be disclosed into documents that also regulate the technological environments in which oral history materials are processed and utilized.
