The authority of police officers to enter buildings and other premises is a crucial means of exercising police power to protect the lives, physical safety, and property of citizens. However, current laws stipulate entry requirements and sanction standards differently depending on individual laws, such as the Act on the Operation and Processing of 112 Emergency Calls, the Act on the Execution of Duties by Police Officers, the Act on the Prevention of Domestic Violence and Protection of Victims, etc., and the Special Act on the Punishment, etc. of Child Abuse Crimes. This results in a burden of judgment for field officers and causes confusion in response. Accordingly, this study aims to examine the problems with regulations regarding police officers' entry authority and to propose improvement measures for legal integration.
To this end, the regulations on entry authority in relevant laws were compared and analyzed, and prior research, judicial precedents, and case studies were reviewed. The analysis revealed that because the entry requirements, purposes of entry, and sanction systems in current laws differ, the police response method may vary depending on the applicable law even in the same situation. Furthermore, the analysis revealed that the concentration of responsibility regarding entry decisions on individual field officers may hinder proactive on-site response, and that the effectiveness of exercising entry authority is limited due to varying levels of sanctions across different laws for acts of refusing entry or obstructing access.
Accordingly, this study categorizes police officers' entry authority into criminal and administrative entry and suggests the need to standardize the purpose and requirements of such authority under unified criteria. It also proposes the establishment of institutional guarantees and post-control systems for officers' decisions on entry, as well as the refinement of sanctions and procedures regarding acts of refusing entry or obstructing access. However, this study has limitations in that it was conducted primarily through the analysis of laws, judicial precedents, and case studies; therefore, it is necessary to examine the applicability of the proposed integrated standards in the future through surveys on the perceptions of field officers.
