This study examines the structural limitations of the current child abuse response system and explores policy directions for strengthening the protection and recovery of child victims. Following the “Jeong-in case,” the responsibilities of the central and local governments for child protection were reinforced, and the parental right to discipline under the Civil Act was repealed in 2021. Nevertheless, official statistics show that child abuse reports reached 50,242 in 2024. Moreover, 82.9% of confirmed cases occurred in the home, and parents accounted for 84.1% of perpetrators, indicating that abuse remains concealed within private spaces and close caregiving relationships.
This study conducts a literature-based policy analysis of government statistics and policy documents, relevant laws, National Police Agency guidelines on abuse and discipline, and prior research. It examines the characteristics of child abuse, the criteria for distinguishing discipline from abuse, and the limitations of the response system across homes, schools, childcare facilities, medical institutions, and public childcare services. The findings indicate that the current system focuses more on post-report investigations and punishment than on early detection and continuous long-term support for child victims.
Accordingly, this study proposes a shift toward “restorative protection,” encompassing safety, psychological and emotional treatment, stable protective environments, and long-term developmental support while maintaining the punishment of perpetrators.
It also recommends expanding community-based protection infrastructure, establishing multi-layered monitoring that combines human oversight, documentation, external inspection, and reporting, and strengthening proactive identification through public administrative data. These proposals extend child abuse policy beyond punishment toward the continuous protection and recovery of child victims.
