Airports are complex operational environments jointly managed by government agencies, airport operators, air carriers, and various on-site contractors. Airport personnel may misuse legitimate access privileges and operational information, thereby undermining the effectiveness of access control and security screening. Accordingly, aviation security law should manage the entire lifecycle of access privileges—from authorization and use to re-vetting, modification, and revocation—based on job sensitivity, access privileges, and changes in risk over time. This study analyzes the current and amended Aviation Security Act and compares the legal frameworks of the United States, the United Kingdom, and the European Union, together with relevant domestic and foreign cases. The analysis finds that the amended Act strengthens controls over access to security-restricted areas and improves oversight and reporting mechanisms. However, neither the current nor the amended Act directly regulates risk classification, periodic and event-triggered re-vetting, integrated analysis of access records, or the managerial responsibilities of contractors. Cases demonstrate that legitimate work routes and access privileges may be exploited to facilitate smuggling, firearms trafficking, unauthorized use of aircraft, misuse of maintenance privileges, and terrorist plots. To address these regulatory gaps, this study proposes a new Article 14-3 of the Aviation Security Act. The proposed provision establishes risk classification based on job duties and access privileges, differentiated controls, re-vetting, and the analysis of access records. It prohibits adverse decisions based solely on automated system alerts and requires an authorized officer to review the grounds for the decision and the possibility of error. It also guarantees affected personnel notice of the decision and an opportunity to challenge it. Responsibility is allocated according to the information held and the actual control exercised by each entity. The proposed framework should be expanded only after phased pilot implementation and independent evaluation.

공항은 국가기관, 공항운영자, 항공운송사업자와 여러 상주ㆍ위탁업체가 함께 운영하는 복합공간이다. 공항 종사자는 적법한 출입권한과 업무정보를 악용하여 출입통제와 보안검색의 실효성을 약화할 수 있다. 직무의 민감도, 접근권한과 시간에 따른 위험변화를 기준으로 권한의 부여, 사용, 재검증, 조정과 회수를 관리해야 한다. 본 연구는 현행 「항공보안법」과 개정 「항공보안법」을 분석하고, 미국ㆍ영국ㆍEU 제도와 국내외 사례를 비교하였다. 분석 결과, 개정 「항공보안법」은 보호구역별 출입범위와 감독ㆍ신고체계를 보완한다. 그러나 위험분류, 정기ㆍ수시 재검증, 출입기록의 연계ㆍ분석과 위탁 인력의 관리책임을 직접 규정하지 않아 내외 사례도 정상적인 업무 동선과 접근권한이 밀수, 총기 운반, 항공기 무단사용, 정비권한 악용과 테러 기도의 수단으로 전환될 수 있음을 보여준다. 본 연구는 이러한 규율공백을 보완하기 위하여 「항공보안법」 제14조의3 신설안을 제시한다. 신설안은 직무와 접근권한에 따른 위험분류, 차등통제, 재검증과 출입기록 분석을 규정한다. 시스템 경보만으로 불이익을 확정하지 않고, 권한 있는 담당자가 판단 근거와 오류 가능성을 재검토하도록 한다. 종사자에게는 결과 통지와 이의제기 기회를 보장한다. 책임은 각 주체가 보유한 정보와 실제 통제권한에 따라 배분한다. 이 제도는 단계적 시범운영과 독립평가를 거쳐 확대해야 한다.
