Smart contracts, which are being used in the trading of cryptocurrencies or virtual assets, are expanding into transactions across various fields for reasons such as their convenience, and one of those is real estate transactions. Im this paper, I examined whether real estate transactions utilizing blockchain-based smart contracts could satisfy all the requirements stipulated in the Real Estate Act. Under civil law, the principle of the effectus arises in the change of real property rights, so a change of real rights does not occur solely through a smart contract. Nevertheless, misunderstanding the characteristic of smart contracts—that the signing and execution occur simultaneously—can cause serious problems for the parties using them in real estate transactions. In other words, the buyer may mistakenly believe that ownership has been acquired because it was concluded through a smart contract, but since the registration was not completed, it does not acquire ownership of the real estate. Also, even if real estate ownership or shares are traded in cryptocurrency, the coins do not become the real estate ownership or shares; they merely acquire the status of a creditor. Finally, while smart contracts eliminate the burden of brokerage fees through direct transactions between the parties, it is important to consider that, given the diverse roles of licensed real estate agents in property transactions, trading property through a smart contract solely because of the brokerage fee burden could result in greater losses. Although this review examined the legal issues that may arise when smart contracts are integrated into real estate transactions, under the current legal framework it is judged that, as of now, it is not appropriate to conduct real estate transactions through smart contracts, because greater risks may arise from the benefits of conducting real estate transactions via smart contracts rather than fewer. However, since the current real estate-related legislation is based on the environment of the 20th century, legislation that adequately reflects the environment of the 21st century is required. Also, since merely amending the law cannot fully meet the demands of the changed transaction environment, the restructuring of the registration-related system must also be carried out simultaneously.

암호화폐 또는 가상자산의 거래에 활용되고 있는 스마트계약은 그 편의성 등을 이유로 다양한 분야의 거래로 확대되고 있으며, 그 중 하나가 부동산거래이다. 이 논문에서는 블록체인 기반 스마트계약을 활용한 부동산거래가 부동산법에서 규정하고 있는 요건을 모두 충족할 수 있는지에 대해 연구하였다. 우리의 경우 부동산물권변동에 있어서 효력발생주의를 취하고 있기 때문에 스마트계약만으로는 물권변동이 발생하지 않는다. 그럼에도 불구하고, 체결과 이행이 동시에 이루어진다는 스마트계약의 특징을 잘못 이해하여 이를 부동산거래에서 활용하는 당사자에게 매우 큰 문제를 야기할 수 있다. 즉, 매수인은 스마트계약을 통해 체결하였기 때문에 소유권을 취득하였다고 오인할 수 있지만, 등기를 경료하지 않았기 때문에 부동산에 대한 소유권을 취득하지 못한다. 또한 부동산소유권 또는 지분을 코인화하여 거래하 더라도 그 코인이 부동산소유권 또는 지분이 되는 것은 아니며, 단지 채권자의 지위를 가질 뿐이다. 마지막으로 스마트계약은 당사자의 직거래에 따라 중개료를 부담하지 않게 되지만, 부동산거래에서 공인중개사의 역할은 다양하다는 점을 감안한다면 중개료 부담을 이유로 스마트계약의 방식으로 부동산을 거래한다는 것은 더 큰 손해를 입을 수 있다는 점을 감안할 필요가 있다. 이처럼 스마트계약이 부동산거래에 접목되었을 때 발생할 수 있는 법적인 문제에 대해 검토하였지만, 현행법 체계하에서는 스마트계약을 통해 부동산을 거래할 때에 발생하는 이점보다는 더 큰 위험이 발생할 수 있기 때문에 현재를 기준으로는 스마트계약의 방식으로 부동산을 거래하는 것은 적절하지 않다고 판단된다. 다만, 현행 부동산관련 법제는 20세기의 환경을 기반으로 하고 있기 때문에 21세기의 환경을 충분히 반영한 입법이 요구된다. 또한 법률의 개정만으로는 변화된 거래환경의 수요를 충분히 충족할 수 없기 때문에 등기와 관련된 시스템의 개편도 동시에 이루어져야 할 것이다.

법은 善과 術(Jusest ars boni et eaqui)이라고 한다. 법학 연구의 일반적인 경향은 선과 형평에 관한 문제를 실체법분야에서 총괄적으로 다룬다면, 그 '術'에 해당하는 부분은 소송법 분야에서 다루어진다 할 것이다. 법학은 모름지기 실체법을 외면한 소송법만의 연구가 허탈에 빠지게 되고, 또 소송법을 경시하는 실체법만의 연구도 공허할 수 밖에 없다. 민사법의이론과실무학회는 실체법과 소송법이라는 구체적 전문성의 차이가 있음에도 불구하고 공동발표회를 가짐으로써 상호 보완하고 보다 깊게 민사법 연구의 전문성을 살려나가는데 그 목적이 있다.
