A Study on Legal Regulation of Betel Nut in Public Health — Focusing on Betel Nut Chewing Culture in China and Other Major Countries —
빈랑의 공중보건상 법적 규제에 관한 고찰 - 중국 등 주요 국가의 빈랑 섭취 문화를 중심으로 -
Areca nut has long been used as a traditional snack and medicinal ingredient in China and Southeast Asia, deeply integrated into local cultures. However, arecoline, an alkaloid contained in areca nut, is carcinogenic. The International Agency for Research on Cancer has classified areca nut as a Group 1 carcinogen. Long-term and excessive consumption damages the oral mucosa, causes oral submucous fibrosis, oral cancer, oral ulcers and other oral diseases. It is a major driver of rising oral cancer rates especially among young people, posing a severe threat to public health. Existing domestic and overseas studies mainly focus on the pharmacological components and epidemiological impacts of areca nut. Most research overemphasizes its cultural and economic value, while systematic research on regulatory measures remains insufficient. This study analyzes the chemical composition and bioactive substances of areca nut, and compares legal regulations governing its production, circulation and sales across the globe. It also examines relevant policies and their implementation effects in Chinese mainland, Taiwan region, Australia, Turkey, Canada, Singapore and other countries, alongside the economic status and traditional cultural significance of the areca nut industry. While areca nut serves as a key source of income for farmers and a long-standing custom in some regions, its health risks cannot be ignored. This paper proposes practical legal regulatory measures to reduce carcinogenic hazards while preserving the medicinal value and cultural traditions of areca nut. It puts forward multi-dimensional public health strategies, including optimizing the management system covering the entire chain of production, processing and distribution, strengthening public health education and preventing underage consumption. A reasonable regulatory framework that balances cultural heritage and public health is expected to reduce the disease burden related to areca nut and facilitate the sustainable development of the industry.

빈랑은 중국과 동남아시아 지역에서 오랜 기간 간식이자 전통 약용 식재료로 활용되며 지역문화에 깊이 자리 잡았다. 하지만 빈랑에 함유된 알칼로이드 성분인 아레콜린은 발암성을 지니며, 세계보건기구 산하 국제암연구소에서 1군 발암물질로 분류한 바 있다. 장기적이고 과도한 빈랑 섭취는 구강 점막 손상, 구강점막하 섬유화, 구강암, 구내염 등 각종 구강 질환을 유발하며, 특히 젊은층의 구강암 발병률 상승의 주요 원인으로 지목되고 있어 심각한 공중보건 문제를 일으키고 있다. 현재 국내외 연구는 주로 빈랑의 약리 성분과 섭취에 따른 역학적 영향에 집중되었으며, 문화적・경제적 가치를 중시한 나머지 체계적인 규제 방안 연구는 부족한 실정이다. 본 연구는 빈랑의 화학적 조성과 생리 활성 성분을 분석하고, 전 세계 각국의 빈랑 생산, 유통, 판매 관련 법적 규제 현황을 비교 검토했다. 또한, 중국 본토 및 대만 지역을 비롯해 호주, 튀르키예, 캐나다, 싱가포르 등 여러 국가의 규제 정책과 시행 효과를 분석했으며, 빈랑 산업의 경제적 위치와 전통 문화적 의의도 함께 고찰했다. 빈랑은 일부 지역에서 주요 농가 소득원이자 전통 풍습으로 유지되고 있지만, 건강 위험을 방치할 수 없다. 본 논문은 빈랑의 약용 가치와 문화 전통은 보호하면서도 발암 위험을 낮출 수 있는 실효성 있는 법적 규제 방안을 제시하고, 생산・가공・유통 전 과정의 관리체계 개선, 대중 건강교육 강화, 청소년 섭취 차단 등 다차원적인 공중보건 정책을 제안했다. 문화전통과 공중보건의 균형을 맞춘 합리적인 규제 정책이 빈랑 관련 질병 부담을 줄이고 산업의 지속 가능한 발전을 이끌어낼 수 있을 것으로 기대한다.
