The large-scale application of medical artificial intelligence (MAI) in clinical diagnosis, auxiliary treatment, health management and other scenarios in China has significantly improved medical efficiency and accuracy. However, due to technical and legal characteristics such as algorithm black boxes, diverse entities, and ambiguous causal relationships, it has also triggered complex issues of responsibility allocation, becoming a key bottleneck that hinders the standardized development of medical AI, infringes upon the legitimate rights and interests of patients and medical staff, and impedes the high-quality development of the medical industry. This article takes the technical essence and legal positioning of medical AI in China as the logical starting point, systematically reviews the research status and judicial practice of responsibility allocation for medical AI, and deeply analyzes the four core problems of responsibility subject definition, application of liability attribution principles, causal relationship determination, and burden of proof configuration; combined with relevant domestic and international norms such as the Civil Code and the AI Act, and drawing on risk liability theory and algorithm governance theory, it constructs a responsibility allocation system of “dynamic attribution, algorithm transparency, and risk sharing”, clearly defining the responsibility boundaries and fault determination standards of the four parties: developers, medical institutions, medical staff, and patients; finally, from the four dimensions of legislative improvement, regulatory collaboration, judicial adaptation, and insurance support, it proposes the implementation paths for the system, providing theoretical references and practical solutions for resolving medical AI liability disputes, balancing technological innovation and patient rights, and promoting the standardized and healthy development of the medical AI industry.

의료인공지능(Medical Artificial Intelligence, MAI)은 중국에서 임상진단, 보조치료, 건강관리 등 분야에 대규모로 활용되며, 의료 효율성과 정확도를 크게 높였다. 하지만 알고리즘 블랙박스, 다중 책임주체, 인과관계의 모호성 등 기술적・법률적 특성으로 인해 복잡한 책임분배 문제가 발생한다. 이는 의료인공지능의 표준화 발전을 저해하고, 의사와 환자의 합법적 권리를 침해하며, 의료산업의 고품질 발전을 가로막는 핵심 장애요인이다. 본 논문은 중국 의료인공지능의 기술 본질과 법률적 지위를 논리적 출발점으로 삼아 의료인공지능 책임분배 관련 연구 현황과 사법실무를 체계적으로 정리하고, 책임주체 규정, 귀책원칙 적용, 인과관계 인정, 입증책임 분배의 네 가지 핵심 난제를 심도 있게 분석하였다. 중국 민법전, 인공지능법 등 국내외 관련 법규를 참고하고 위험책임이론과 알고리즘 거버넌스 이론을 바탕으로 동적 귀책, 알고리즘 투명화, 위험공동부담을 기본으로 하는 책임분배 체계를 구축하였으며, 개발자, 의료기관, 의료인, 환자 네 가지 주체의 책임 경계와 과실 인정 기준을 명확히 하였다. 또 입법 완비, 규제 협력, 사법 적응, 보험 연계의 네 차원에서 제도 실현 방안을 제시하여, 의료인공지능 책임 분쟁해결, 기술혁신과 환자의 권리보호, 의료인공지능 산업의 표준화・건전한 발전에 이론적 참고와 실천적 방안을 제공한다.
