바이오데이터의 범주와 국외 이전에 관한 법적 고찰 - 「바이오데이터 법안」에 대한 검토를 중심으로 -
A Legal Study on the Scope and Cross-Border Transfer of Biodata - Focusing on the Review of the “Biodata Bill” -
The extraterritorial transfer of biodata has emerged as a critical global legal and policy issue, driven by the deepening of the data economy, the proliferation of precision medicine and AI-based drug discovery, and the ubiquity of cloud computing. Biodata possesses extreme sensitivity that is irreparable upon leakage, low variability with high long-term preservation value, and a dual nature as both personal information and a public good. Furthermore, it constitutes a core element of “data security,” as the aggregation and overseas transfer of a nation's genomic information could be misused as foundational data for biological weapons or as a strategic tool for hostile states. Within the digital legal frameworks of the U.S., China, the EU, and Japan, regulations on the overseas transfer of biodata are diverging based on its sensitive nature. Depending on national interests, some jurisdictions strictly regulate transfers by prioritizing security, while others adopt a trust-based cooperative model to facilitate data flow for specific purposes. In South Korea, the 22nd National Assembly proposed the “Act on the Utilization of Biodata and Promotion of AI-Bio Research and Development” (the “Biodata Bill”). This bill aligns with the latter approach, relaxing regulations for limited purposes such as research. However, the Biodata Bill reveals significant flaws on two levels. First, in terms of conceptual definition, the “health and medical information” included within the scope of biodata is heterogeneous with the original biological and biochemical categories of biodata. In the context of natural persons, health and medical data could arguably be seen as a broader concept than biodata, necessitating a re-establishment of these definitions. Second, regarding the special provision for overseas transfer (Article 24), several concerns persist: the discrepancy in de-identification standards between statutes by allowing transfers based on pseudonymization—a lower threshold than the anonymization required by the Bioethics Act; the difficulty of preventing commercial diversion solely through the purpose requirement of “verifying academic publications”; and the absence of a pre-review process to assess the data protection levels of recipient countries. Balancing medical advancement through the free flow of biodata with its protection as a national strategic asset, South Korean legislation urgently requires supplementation. This should center on ensuring conceptual consistency, unifying de-identification standards, and introducing a rigorous pre-review procedure for data recipients.

바이오데이터의 국외 이전 문제는 데이터 경제의 심화, 정밀의료 및 인공지능 기반 신약 개발의 확산, 클라우드 컴퓨팅 환경의 일상화를 배경으로 최근 가장 첨예한 글로벌 법・정책 쟁점으로 부상하고 있다. 바이오데이터는 유출 시 복구 불가능한 극도의 민감성, 낮은 가변성과 높은 장기 보존 가치, 개인정보이면서 동시에 공공재적 성격을 겸비한다는 이중성을 지니며, 특정 국가 국민의 유전체 정보가 집적되어 해외로 이전될 경우 생물학적 무기 개발의 기초 자료로 악용되거나 적대 국가의 전략적 공격 수단이 될 수 있다는 점에서 ‘데이터 안보’의 핵심 요소를 구성한다. 디지털 법제 체계 내에서 미국・중국・유럽연합・일본의 개인정보와 바이오데이터의 국외 이전 간에는 바이오데이터가 지니는 민감정보라는 특성으로 인해, 각국의 상황에 따라 안보를 우선시하여 국외 이전을 엄격하게 규제하는 방향과 그 반대로 특정 목적 하에 신뢰를 기반으로 하는 협력형으로 규제가 완화되는 방향이 나타나고 있다. 우리나라에서는 제22대 국회에서 「바이오데이터 활용 및 인공지능바이오 연구개발 촉진에 관한 법률안(이하 ‘바이오데이터 법안’)」이 발의되었는데, 바이오데이터의 국외 이전에 대해서는 연구 등 제한적 목적으로 한정하여 국외 이전을 완화하는 후자에 가까운 형태를 띄고 있다. 또한 「바이오데이터 법안」은 두 가지 차원의 문제점이 확인된다. 우선 개념 정의의 차원에서, 법안이 바이오데이터의 범주에 포함시킨 보건의료정보는 생물학・생화학적 분야에서 파생되는 바이오데이터 본래의 범주와 이질적이며, 오히려 자연인을 상정할 때 보건의료데이터가 바이오데이터의 상위 개념에 위치할 수 있어 개념의 재정립이 필요하다. 다음으로 국외 이전 특례 조항(제24조)에 대해서는, 생명윤리법이 요구하는 익명화보다 낮은 수준인 가명처리만으로 국외 이전을 허용함으로써 두 법령 간 비식별화 기준의 불일치가 발생하는 점, ‘학술지 게재 논문의 검증’이라는 목적 요건만으로는 상업적 전용 가능성을 차단하기 어렵다는 점, 이전 상대방 국가의 데이터 보호 수준에 대한 사전 심사 절차가 부재하다는 점이 우려되는 사항이다. 바이오데이터의 자유로운 흐름을 통한 의학적 발전과 국가 전략 자산으로서의 보호 사이에서, 우리나라의 법제에서는 개념의 정합성 확보, 비식별화 기준의 일원화, 이전 상대방에 대한 사전 심사 절차의 도입을 중심으로 하는 입법적 보완이 시급하다.
