Regarding the civil liability system due to medical malpractice, the US and New Zealand systems were reviewed and the implications were examined. First of all, in the case of medical accidents in the United States, case law has been developed around tort liability, and alternative dispute resolution systems are also used, and some states require medical malpractice liability insurance to be subscribed. Korea's system or legal principles do not appear to be particularly inferior to the US system. However, there is room for reviewing the mandatory medical malpractice insurance adopted by some states in the United States to provide prompt and sufficient compensation to victims, and in this case, measures such as preventing the increased premium from being passed on to the patient should be introduced together. New Zealand has a no-fault compensation system in which the state compensates for no negligence of medical staff through the Accidents Compensation Corporation (ACC). This system can be evaluated as an alternative to avoid the problems of Korea's negligence liability system as it reduces the burden of litigation on both patients and doctors and allows them to focus on their own purposes of compensation and treatment. However, in light of the fact that introducing this system requires enormous financial resources, it is not realistic to accept the ACC system as it is. Instead, it is reasonable to first introduce a no-fault damage compensation system such as the ACC system from essential medical fields such as obstetrics and gynecology and emergency medical care, and gradually expand the scope of application, and further review is needed for other measures to secure financial resources.

의료과오로 인한 민사책임 체계와 관련하여, 미국과 뉴질랜드의 체계를 검토하여 시사점을 살펴보았다. 먼저 미국의 경우, 의료사고는 불법행위책임을 중심으로 판례 법리가 발전되어 왔고, 대체적 분쟁해결 제도도 활용되고 있으며 일부 주에서는 의료과오배상책임보험 가입을 의무화하고 있다. 우리나라의 제도나 법리가 미국 제도에 비해 특별히 열위에 있는 것으로 보이지는 않는다. 다만 피해자에게 신속하고 충분한 보상을 제공하기 위해 미국 일부 주에서 채택하고 있는 의료과오배상보험 가입 의무화를 검토할 여지가 있고, 이 경우에도 증가된 보험료가 환자에게 전가되지 않도록 하는 등의 방안이 함께 도입되어야 한다. 뉴질랜드는 사고보상공사(Accident Compensation Corporation, 이하 ACC)를 통해 의료진의 과실이 없더라도 국가가 보상하는 무과실 손해배상 체계를 갖추고 있다. 이 제도는 환자와 의사 양측에 소송 등 부담을 줄이고 보상과 진료라는 각자의 목적에 집중할 수 있도록 하므로 우리나라의 과실책임 체계가 갖고 있는 문제점을 피할 수 있는 대안으로 평가할 수 있다. 다만 이 제도를 도입하려면 막대한 재원이 필요한 점 등에 비추어 보면, ACC 제도를 그대로 수용하는 것은 현실적이지 않다. 그 대신 산부인과・응급의료 등 필수의료 분야부터 ACC 제도와 같은 무과실 손해배상체계를 우선적으로 도입하고 차츰 적용의 범위를 넓혀 가는 방식이 타당하고, 그 외에 재원 확보 방안 등은 추가적인 검토가 필요하다.
