The development of the Green Bio-Industry (green bioeconomy) relies not only on advances in biotechnology but also on the foundational resource of crop genetic diversity. Such diversity cannot be maintained solely through ex situ conservation; rather, it is continuously renewed through farmers practices of saving, selecting, exchanging, and replanting seed in the field. Yet the current Korean legal framework does not adequately accommodate these farmer-led seed management practices and instead places them within a fragmented structure composed of the Plant Variety Protection Act, the Seed Industry Act, and the Agricultural Genetic Resources Act. This results in regulatory uncertainty—particularly concerning farm-saved seed—and a chilling effect on small-scale seed exchange due to criminal sanctions associated with seed business registration. Drawing on international norms including the CBD, ITPGRFA, and UNDROP, as well as the EU's ongoing reform under the Plant Reproductive Material (PRM) Regulation, this study underscores the essential role of informal, farmer-managed seed systems in agrobiodiversity conservation and the green bioeconomy. Based on these insights, it proposes key reforms for Korean seed law: establishing guiding principles that balance agrobiodiversity, industrial development, and legal certainty; introducing a statutory definition of “farmer”; providing narrowly tailored exemptions from seed business registration; and mandating notifications specifying crop species eligible for farm-saved seed. By reframing seed governance as a foundation for biodiversity, farmers rights, and broader national bioeconomy strategies, this study offers a pathway for aligning Korea's seed legislation with emerging global standards.

그린바이오 산업의 성장은 생명공학 기술뿐 아니라 이를 가능하게 하는 기반 자원인 종자 다양성에 의해 좌우된다. 종자 다양성은 저장 중심의 ex situ 방식만으로는 유지될 수 없으며, 농민이 현장에서 종자를 저장・선발・교환・갱신하는 과정을 통해 비로소 지속적으로 재생산된다. 그러나 현행 한국 법제는 이러한 농민의 종자 관리 활동을 명확히 규율하지 못한 채, 식물신품종보호법・종자산업법・농업생명자원법 간의 상이한 규범 구조 속에 놓아두고 있다. 이로 인해 자가채종의 허용 범위는 고시 미제정으로 공백 상태에 있으며, 종자업 등록 요건과 형사처벌 규정은 농민의 소규모 종자 교환과 거래에 위축효과를 초래하는 실정이다. 본 연구는 CBD, ITPGRFA, UNDROP 등 국제 규범과 EU PRM 규정안의 입법례를 검토하여, 농민의 종자 관리 활동을 종자 다양성 보전 및 그린바이오 산업 기반 구축의 핵심 요소로 재평가할 필요성을 제기한다. 이를 바탕으로 첫째, 종자 다양성 보전・산업 기반 강화・권리 안정성의 조화를 이루는 기본 원칙 설정, 둘째, ‘농민’ 정의 조항의 신설, 셋째, 일정 요건을 충족하는 농민에게 종자업 등록 예외를 인정하는 조항 도입, 넷째, 식물신품종보호법상 자가채종 허용 작물 고시의 제정 의무화 등을 핵심 개선안으로 제시한다. 본 연구는 종자 규제를 단순한 산업관리의 문제가 아니라 생물다양성과 농민권, 그리고 국가 바이오전략의 기반으로 재구성하는 관점을 제안하며, 한국의 종자 법제를 그린바이오 시대에 적합한 방향으로 전환하는 데 기여하고자 한다.
