Expressive conduct in AIGC contexts faces three identification difficulties: the unobservability of a model's internal operations, the nonlinear generation of model outputs, and the conversion of facts about the generation process into proxy indicators. These difficulties arise because the assumption of limited human–AI separability underlying existing methods conflicts with the reality of human–AI co-constitution in AIGC. “Approximation” should therefore serve as the method for identifying expressive conduct. In AIGC, approximation comprises the clarification of an idea, the unfolding of conduct, and the convergence of expressive form: through interaction with the model, the user's idea becomes progressively clearer, expressive conduct progressively unfolds, and expressive form progressively converges. A court applying approximation should first identify the external expressive trajectory holistically; determine whether that trajectory constitutes expressive conduct by examining the directedness of the overall interaction, the responsiveness between successive stages, and the relative determinacy of the final expressive form; identify the expressive relations attributable to the user; and only then apply the originality standard to determine whether those relations constitute a work.

AIGC 맥락에서 표현행위를 판단하는 데에는 모델 내부 과정의 비가시성, 모델 출력의 비선형적 생성, 그리고 생성과정의 사실이 지표화됨으로써 발생하는 세 가지 곤란이 존재한다. 그 근본 원인은 기존 판단방법이 전제하는 인간과 AI의 제한적 분리 가능성이 AIGC에서 나타나는 인간-AI 상호구성의 현실과 충돌한다는 데 있다. 이에 본 논문은 표현행위의 판단방법으로 ‘점진적 구체화’를 제시한다. AIGC에서 점진적 구체화는 ‘사상의 명료화—표현행위의 전개—표현형태의 수렴’으로 구성된다. 즉 모델과의 상호작용을 거치면서 이용자의 사상이 점차 명료해지고, 표현행위가 지속적으로 전개되며, 표현형태가 연속적인 수정 속에서 상대적으로 확정된다. 사법기관은 먼저 이용자의 외부 표현궤적을 전체적으로 식별하여야 한다. 이어 전체 상호작용의 지향성, 전후 상호작용 단계의 응답성, 최종 표현형태의 상대적 확정성을 기준으로 그 궤적이 표현행위에 해당하는지를 판단하고, 이용자에게 귀속될 수 있는 표현관계를 확정하여야 한다. 그 후 일반적인 독창성 기준을 적용하여 해당 표현이 저작물에 해당하는지를 심사하여야 한다.
