As artificial intelligence (AI) increasingly plays a central role in the inventive process, the interpretation of inventorship requirements and the patent law concept of conception has emerged as a significant legal issue. This article examines the meaning of conception under U.S. patent law by analyzing the changes introduced in the United States Patent and Trademark Office (USPTO) Inventorship Guidance for AI-Assisted Inventions issued in 2024 and its revised version in 2025, together with relevant judicial precedents. It further explores the limitations of the traditional conception doctrine through recent AI-assisted innovation practices in biotechnology and drug discovery, materials science, and semiconductor technology. In particular, the article considers whether a human inventor's evaluation, selection, and modification of AI-generated outputs can satisfy the legal requirement of conception and discusses the evidentiary issues involved in proving human inventorship in AI-assisted inventions. Based on this analysis, the article addresses the need to balance the human-centered inventorship principle with the promotion of AI-driven innovation while considering issues of accessibility and equity arising from AI technologies. Finally, it argues that, in the long term, a new patent framework specifically designed to reflect the unique characteristics of AI-assisted inventions should be considered.

인공지능(AI)이 발명 과정에서 핵심적인 역할을 수행하는 사례가 급속히 증가함에 따라, 인간을 발명자로 인정할 수 있는 기준과 특허법상 “착상(conception)”의 개념을 어떻게 해석할 것인지가 중요한 법적 쟁점으로 부상하고 있다. 본 논문은 미국 특허청(USPTO)의 2024년 및 2025년 AI 보조 발명 관련 지침의 변화와 주요 판례를 중심으로 미국 특허법상 “착상”의 의미를 분석하고, 바이오·신약개발, 재료과학, 반도체 분야에서의 AI 활용 사례를 통해 전통적인 “착상” 개념이 직면한 한계를 검토하였다. 또한 AI가 생성한 결과물에 대한 인간의 평가·선정·수정 행위가 발명자의 착상으로 인정될 수 있는지, AI를 이용한 발명에서 인간의 발명자 적격을 어떠한 증거로 입증하여야 하는지를 살펴보았다. 이를 바탕으로 인간 중심의 발명자 원칙과 AI 기반 혁신 촉진 간의 균형, AI 활용에 따른 접근성과 형평성 문제를 검토하고, 장기적으로는 AI 이용 발명의 특성을 반영한 새로운 특허제도와 법적 체계의 필요성을 제안하였다.
