마약류 사범의 재사회화 방안에 관한 소고 : 치료적 사법의 실효성 제고를 위하여
A Study on the Resocialization of Drug Offenders : Focusing on Enhancing the Effectiveness of Therapeutic Jurisprudence
Recently, domestic drug crimes have been continuously increasing, which suggests that the current punishment-oriented criminal justice system fails to respond effectively to such offenses. Drug crimes possess complex characteristics, including addiction and dependency, as well as organizational secrecy and transnationality. Thus, punishment alone cannot be the ultimate solution; active interventions such as treatment and rehabilitation tailored to these specific traits are indispensable. This is not to say that current treatment and rehabilitation systems do not exist; indeed, mechanisms such as Medical Treatment and Protection and Medical Treatment and Custody are in place. However, within a structure where ordinary criminal procedures remain central, these therapeutic alternatives are highly susceptible to becoming mere formalities—and they are practically doing so. Furthermore, the shortage of specialized personnel and facilities cannot be overlooked. This study examines the therapeutic jurisprudence systems related to drug addiction in major foreign countries and, based on these findings, proposes the establishment of an integrated system combining ordinary criminal procedures with treatment and rehabilitation processes. It is essential to establish an integrated judicial-therapeutic process that obligates judicial authorities to assess whether a drug offender suffers from addiction and requires treatment, subsequently reflecting the outcomes in indictment, trial procedures, and sentencing. What we urgently need now is not simply adopting the superficial format of new institutions like foreign drug courts. Rather, it lies in enabling judicial authorities, medical institutions, and local communities to function within a single, continuous system. To achieve this, a fundamental paradigm shift is required—one that perceives drug addiction not merely as an object of punishment, but as a subject of treatment and management.

최근 국내 마약류 범죄가 지속적으로 증가하고 있다. 이는 처벌 중심의 현행 사법 체계가 마약류 범죄에 효과적으로 대응하지 못하고 있음을 시사한다. 마약류 범죄는 중독·의존성뿐만 아니라 조직·은밀성, 초국경성 등의 복합적 특성을 지닌다. 오직 처벌만이 능사가 아니다. 그 특성에 맞춘 치료·재활 등의 적극적 개입이 필수불가결하다. 현행 치료·재활 제도가 없는 것은 아니다. 치료보호, 치료감호 제도가 있다. 그러나 일반 형사절차가 중심이 되는 구조 하 그 절차들은 형해화될 우려가 크고 실제로도 그러하다. 전문인력·시설의 부족 문제 역시 간과할 수 없다. 본고는 해외 주요국의 마약류 중독 관련 치료적 사법 제도를 고찰, 일반 형사절차와 치료·재활 절차의 통합 체계 구축을 제안하고자 한다. 현행 제도는 형사절차와 치료 절차가 분리·운영, 치료가 필요한 대상자도 처벌 중심의 절차 내에서 처우되는 문제가 있다. 형사절차 내 필요적으로 마약류 사범의 중독 및 치료 필요성 여부를 판단하게 하고 그 결과를 공소 및 공판절차 나아가 양형에 반영토록 하는 사법·치료 통합 프로세스의 정립이 필요하다. 또한 기존 치료보호 위원회의 역할을 확대, 형사절차 전반에 마약류 사범에 대한 전문인력의 개입이 가능토록 제언코자 한다. 지금 우리에게 필요한 것은 외국의 약물법원과 같은 새로운 제도의 외형을 도입하는 데 있는 것이 아니다. 사법기관, 의료기관, 지역사회가 하나의 연속적 체계 안에서 기능토록 하는 데 있다. 그리고 무엇보다도 마약류 중독의 문제를 처벌의 대상이 아닌 치료와 관리의 대상으로 보는 인식의 대전환이 필요하다.
