A Study on the Limitation Period for North Korean Residents’ Claims for Payment of the Equivalent Value of Inheritance Shares -In Light of the Constitutional Court’s Decision 2021Hun-Ma1588, June 27, 2024 -
The most significant problem with the right to claim recovery of inheritance under the current Civil Act is that the short limitation period may result in genuine heirs being sacrificed while apparent heirs are protected. The Supreme Court’s en banc decision of October 19, 2016, 2014Da46648, was a case in which the application of this limitation period for the right to claim recovery of inheritance to the Act on Special Cases Concerning Family Relations, Inheritance, etc. between Residents of South and North Korea (hereinafter, the “Special Act”) ultimately resulted in the de facto deprivation of North Korean residents’ inheritance rights. Regardless of whether the second sentence of Article 11(1) of the Special Act is regarded as a provision concerning the right to claim recovery of inheritance or as a special provision concerning Article 1014 of the Civil Act, the current Special Act contains no independent provision governing the limitation period applicable to a North Korean resident’s claim for payment of the equivalent value of an inheritance share. Accordingly, if the legal principles set forth in the aforementioned en banc decision are maintained without modification, under the current law, the limitation period prescribed in Article 999(2) of the Civil Act would also apply to a North Korean resident’s exercise of a claim for payment of the equivalent value of an inheritance share against a South Korean resident. However, with respect to the exercise of such a claim, the latter part of Article 999(2) of the Civil Act lost its effect as unconstitutional pursuant to the Constitutional Court’s decision of June 27, 2024, 2021Hun-Ma1588. Therefore, at present, only the three-year limitation period prescribed in the first part of the same paragraph, running “from the date on which the infringement of the inheritance right became known,” applies. The problem is that, unlike the right to claim recovery of inheritance, for which the Special Act provides no special rule concerning the limitation period, the Special Act establishes a special rule regarding the starting point of the limitation period for an action for acknowledgment of paternity against a deceased father or mother and an action for confirmation of the existence of a parent-child relationship. Under this special rule, the limitation period runs for two years “from the date on which the grounds preventing the filing of the action cease to exist due to the termination of the division of the Korean Peninsula, the resumption of free movement, or other circumstances.” When this special provision concerning the starting point of the limitation period is considered in conjunction with the aforementioned Supreme Court en banc decision and the Constitutional Court’s decision declaring the relevant provision unconstitutional, a North Korean resident who acquires the status of an heir upon the finalization of an action for acknowledgment of paternity or an action for confirmation of the existence of a parent-child relationship may exercise a claim for payment of the equivalent value of an inheritance share so long as the action is brought “within three years from the date on which the acknowledgment or judgment becomes final and conclusive.” Accordingly, even if ten years have elapsed from the date of the infringement of the inheritance right, where inheritance has already commenced and the inherited property has been divided or otherwise disposed of, a North Korean resident who has acquired the status of an heir may, by filing an action within three years from the date on which the acknowledgment or judgment becomes final and conclusive, effectively avoid the limitation imposed by the limitation period applicable to the right to claim recovery of inheritance. In disputes concerning inheritance between residents of South and North Korea, the proposition that not only the protection of the reliance interests of South Korean residents and the security of transactions but also the protection of the inheritance rights of North Korean residents is important cannot be abandoned. Likewise, neither South Korean nor North Korean residents should be compelled to bear particularly unreasonable sacrifices, nor should they be afforded a de facto unlimited privilege merely because they have acquired heirship through the finalization of a particular judicial proceeding. In light of the Constitutional Court’s recent decision declaring the relevant provision unconstitutional, it is necessary to reconsider whether it is appropriate to apply the limitation period under Article 999(2) of the Civil Act to North Korean residents’ claims for payment of the equivalent value of inheritance shares without modification. Furthermore, there is a need to establish, through legislation, a separate limitation period that applies commonly to North Korean residents’ claims for recovery of inheritance and claims for payment of the equivalent value of inheritance shares.

현행 민법상 상속회복청구권의 가장 큰 문제점은 단기의 제척기간으로 인하여 진정상속인은 희생되고 참칭상속인이 보호되는 결과가 초래될 수 있다는 점이다. 이러한 상속회복청구권의 제척기간이 「남북주민 사이의 가족관계와 상속 등에 관한 특례법」에도 적용된다고 보아, 결과적으로 북한주민의 상속권이 사실상 박탈되는 결과가 초래되었던 사건이 대법원 2016. 10. 19. 선고 2014다46648 전원합의체 판결이다. 위 특례법 제11조 제1항 2문을 상속회복청구권에 관한 규정으로 보든 「민법」 제1014조의 특례에 관한 규정으로 보든 현행 특례법상 북한주민의 상속분가액지급청구권에 적용되는 독자적 제척기간 규정은 없으므로, 위 전원합의체 판결이 제시한 법리를 그대로 유지한다면 현행법의 해석상 남한주민을 상대로 한 북한주민의 상속분가액지급청구권의 행사에도 「민법」 제999조 제2항의 제척기간이 적용될 것이다. 그런데, 상속분가액지급청구권 행사와 관련하여서는 헌법재판소 2024. 6. 27. 2021헌마1588 결정에 따라 「민법」 제999조 제2항 후단의 제척기간이 위헌으로 그 효력을 상실하였으므로, 현재는 같은 항 전단의 ‘상속권의 침해를 안 날부터 3년’의 제척기간만이 적용된다. 문제는, 위 특례법이 제척기간에 관한 특례를 두고 있지 않은 상속회복청구권과는 달리, 사망한 부 또는 모를 상대로 하는 인지청구의 소와 친생자관계존재확인의 소의 경우에는 제척기간의 기산점에 대하여 “분단의 종료, 자유로운 왕래, 그 밖의 사유로 인하여 소의 제기에 장애사유가 없어진 날부터 2년”이라는 특례를 두고 있다는 점이다. 이러한 제척기간 기산점에 대한 특례규정에 앞서 살펴본 대법원 전원합의체 판결과 헌법재판소의 위헌결정을 종합하여 보면, 인지청구의 소 또는 친생자관계존재확인의 소가 확정됨으로써 상속인의 지위를 취득한 북한주민이 상속분가액지급청구의 소를 제기하는 경우에는 ‘인지 또는 재판 확정일로부터 3년 내’라는 기간만 준수하여 이를 행사하면 된다. 따라서 ‘상속권의 침해행위가 있는 날’로부터 10년이 경과하였더라도 이미 상속이 개시되어 상속재산분할 기타 처분을 마친 경우에 상속인인 북한주민이 인지 또는 재판 확정일로부터 3년 이내에 소를 제기한다면, 상속회복청구권의 제척기간 제한을 받지 않게 된다. 남북주민 사이의 상속을 둘러싼 분쟁에서는 남한주민의 신뢰와 거래의 안전뿐만 아니라 북한주민의 상속권 보장도 중요하다는 명제는 포기될 수 없다. 마찬가지로 남한주민이나 북한주민 모두 특별히 불합리한 희생을 강요받아서는 안 되며, 상속인 지위를 일정한 재판의 확정에 의하여 취득하였다는 사정만으로 사실상 제한 없는 특혜를 받아서도 안 된다. 이번 헌법재판소의 위헌결정을 계기로, 북한주민의 상속분가액지급청구에 「민법」 제999조 제2항의 제척기간을 그대로 적용하는 것이 타당한지 재검토할 필요가 있으며, 나아가 북한주민의 상속회복청구와 상속분가액지급청구에 공통적으로 적용되는 별도의 제척기간을 입법적으로 마련할 것이 요구된다.
