Legislative Measures to Ensure the Right to Housing of Persons with Disabilities Living in Residential Facilities

Deinstitutionalization policies for persons with disabilities have been promoted with the aim of ensuring their right to self-determination and their right to live in the community. However, a substantial proportion of persons currently residing in residential facilities in Korea are persons with severe developmental disabilities who require continuous care and support, and there are also persons with disabilities and their families who prefer institutional living. Against this background, it is necessary to examine whether policies aimed at the uniform reduction or closure of residential facilities may, in fact, restrict the freedom of choice and self-determination of persons with disabilities who wish to continue living in such facilities. This article examines Article 19 of the Convention on the Rights of Persons with Disabilities (CRPD), General Comment No. 5, and the Guidelines on Deinstitutionalization, analyzes the problems arising from Korea’s Act on Support for Community-Based Independent Living and Housing Transition for Persons with Disabilities and the proposed Act on Support for Deinstitutionalization of Persons with Disabilities, and proposes legislative measures to protect the housing rights of persons with disabilities residing in residential facilities. Article 19 of the CRPD neither expressly mandates deinstitutionalization nor prohibits residential facilities for persons with disabilities. Rather, it guarantees the right of persons with disabilities to choose their place and form of residence and to receive the support necessary to live in the community. By contrast, General Comment No. 5 and the Guidelines on Deinstitutionalization regard institutional living as incompatible with community living and call for the closure of institutions. Such an interpretation warrants reconsideration in light of the text of Article 19 and the rights to self-determination and freedom of choice in housing. Particular attention should also be paid to the characteristics and actual housing needs of persons with severe developmental disabilities who require continuous care and support. The Act on Support for Community-Based Independent Living and Housing Transition for Persons with Disabilities and the proposed Act on Support for Deinstitutionalization of Persons with Disabilities also guarantee the right to self-determination, while at the same time subjecting persons residing in facilities to continuing efforts to transition them to community-based housing. These measures may restrict the choices available to persons with disabilities who wish to continue living in residential facilities. In particular, the proposed Deinstitutionalization Act provides for the gradual reduction of institutional capacity and eventual closure of facilities and restricts transfer to another residential facility, readmission, and return to the family home following facility closure. Such provisions may conflict with the rights to self-determination and freedom of choice in housing of persons with disabilities residing in facilities. Accordingly, disability housing policy should not be based on a dichotomy between residential facilities and the community, nor should it aim at eliminating a particular form of residence. Rather, it should ensure that persons with disabilities are able to choose freely among diverse forms of housing according to the type and degree of disability, their support needs, and their own preferences. To this end, a balanced range of housing options—including residential facilities, group homes, supported housing, shared living arrangements, and 24-hour integrated care centers—should be developed, together with systems capable of continuously providing the care, medical services, and personal assistance necessary for persons with disabilities to live in the housing of their choice. In the long term, an integrated legal framework for housing support for persons with disabilities should be established, centered on the rights to housing and freedom of choice in housing and encompassing diverse housing arrangements and support systems.

장애인 탈시설 정책은 장애인의 자기결정권과 지역사회에서 살아갈 권리를 보장한다는 취지에서 추진되어 왔다. 그러나 현재 시설에 거주하는 장애인의 상당수는 지속적인 돌봄과 보호를 필요로 하는 중증 발달장애인이며, 시설 거주를 희망하는 장애인과 가족 또한 존재한다. 이러한 현실에서 시설을 일률적으로 축소・폐쇄하는 정책이 오히려 시설 거주 장애인의 주거선택권과 자기결정권을 제한할 가능성이 있는지 검토할 필요가 있다. 이 논문은 장애인권리협약 제19조와 일반논평 제5호 및 탈시설가이드라인의 의미를 검토하고, 이에 기초하여 추진된 자립지원법과 탈시설지원법안의 문제점을 분석한 후 시설 거주 장애인의 주거권 보장을 위한 입법적 과제를 제시하는 것을 목적으로 한다. 장애인권리협약 제19조는 탈시설을 명시적으로 규정하거나 장애인거주시설을 금지하고 있지 않으며, 장애인이 자신의 거주지와 주거형태를 선택하고 지역사회에서 필요한 지원을 받을 권리를 보장하고 있다. 반면 일반논평 제5호와 탈시설가이드라인은 시설을 지역사회와 양립할 수 없는 주거형태로 보고 시설 폐쇄를 요구하고 있다. 그러나 이러한 해석은 협약 제19조의 문언과 장애인의 자기결정권 및 주거선택권의 관점에서 재검토될 필요가 있으며, 특히 지속적인 보호와 돌봄을 필요로 하는 중증 발달장애인의 특성과 주거 현실을 충분히 고려할 필요가 있다. 자립지원법과 탈시설지원법안 역시 장애인의 자기결정권을 보장하고 있으면서도 시설 거주 장애인을 지속적인 지역사회 전환의 대상으로 설정하거나 시설의 단계적 축소・폐쇄를 예정함으로써 시설 거주를 원하는 장애인의 선택 가능성을 제한하고 있다. 특히 탈시설지원법안은 시설 입소 정원의 단계적 감축과 시설 폐쇄를 예정하고, 시설 폐쇄 이후 타 시설로의 전원・재입소 및 원가정복귀를 제한한다는 점에서 시설 거주 장애인의 자기결정권 및 주거선택권과 충돌할 소지가 있다. 따라서 장애인 주거정책은 시설과 지역사회를 상호 배타적인 개념으로 설정하거나 특정한 주거형태의 종식을 목표로 하기보다, 장애의 유형과 정도, 지원 필요성 및 당사자의 의사에 따라 다양한 주거형태를 자유롭게 선택할 수 있도록 설계되어야 한다. 이를 위해 시설을 포함하여 그룹홈・지원주택・공동생활주택・24시간 통합돌봄센터 등 다양한 주거형태를 균형 있게 확충하고, 장애인이 선택한 주거공간에서 필요한 돌봄・의료・활동지원 등을 지속적으로 제공할 수 있는 체계를 구축할 필요가 있다. 장기적으로는 장애인의 주거권과 주거선택권을 중심으로 이러한 다양한 주거형태와 지원체계를 포괄하는 통합적인 장애인 주거지원 법체계를 마련하여야 한다.

    인간다운 생활의 보장」은 이제 개인만의 문제가 아니며, 현대 모든 복지국가의 중요한 과제입니다. 우리나라도 국민의 복지향상을 위하여 건강보험·연금보험·산업 재해보상보험·고용보험등 사회보험분야에 사회보험법을, 또 국가유공자·공익행위자의 사회적 보상을 위하여 사회보상법을 제정·시행하고 있으며, 영세민의 기초생활보장과 장애인·노인·아동·여성등의 복지향상을 위하여 사회부조법·사회복지법 내지 사회복지서비스법을 제정·시행하고 있습니다. 그러나 우리나라의 사회법관련제도는 단기간의 외형적 급성장에도 불구하고, 그 역사가 비교적 짧으며, 아직도 초창기에 있습니다. 그 결과 무수한 법개정과 시행착오를 경험하지 않으면 아니되었으며, 현재에도 많은 문제점을 내포하고 있습니다. 그럼에도 불구하고 이 분야 법제도의 학문적·체계적 연구는 아직도 미흡한 실정입니다. 제도는 법을 통하여 생성·변경·소멸됩니다. 사회보험제도, 사회보상제도 및 사회복지제도도 예외가 아닙니다. 이러한 제도의 발달도 그 제도의 기초가 되는 사회법의 심도깊은 연구를 통하여 성취될 수 있습니다. 더구나 이 제도들은 복합적이고, 서로 연관되어 있는 경우가 허다하므로, 여러 전문가와 실무자의 통합적 접근이 필요합니다. 이에 이 분야의 전문지식과 실무경험을 가진 뜻있는 사람들이 모여 사회법과 사회법관련제도를 학문적·체계적으로 집중 연구하고자 합니다. 그로써 우리나라가 지향하고 있는 복지국가에의 길을 좀 더 단축시키는데 기여하고자 합니다. 역사는 단축시킬 수는 있어도 뛰어 넘을 수는 없기 때문입니다. 우리와 뜻을 같이 하시는 많은 분들의 참여를 바랍니다.
