Korean call-center outsourcing firms often require applicants who have passed document screening and interviews to complete job-specific training lasting from several days to several weeks before making a final hiring decision. This article examines the legal status and protection of participants in such recruitment-linked training by analyzing recent court judgments and Labor Relations Commission rulings. The cases indicate that employee status should be assessed in two steps. First, it must be determined whether the training constitutes the provision of labor, with particular attention to who receives the principal benefit of the training. Second, it must be determined whether the activity is performed under the employer’s direction and control. Relevant factors include the training’s close connection to the job, immediate deployment after completion, restrictions on time and place, attendance control, and the nature of any payments. The doctrine of preliminary employment is of limited utility because the parties ordinarily contemplate a separate act of concluding the employment contract after training. Once an employment relationship is established, however, the training period may be characterized as probationary employment in which the employer reserves a right of termination. A chronological comparison of the rulings reveals a risk of “immunity through disclosure”: claims are more likely to be dismissed as employers’ advance notices and documents become more elaborate, even though the substantive nature of the training remains largely unchanged. Because both the duration of training and the wording of disclosure are largely within the employer’s control, interpretation alone cannot close the protection gap. The article therefore proposes amending the Fair Hiring Procedure Act to define recruitment-linked job training, specify mandatory disclosures, require payment at no less than the statutory minimum wage when training exceeds a specified duration, and require written notice stating the reasons for non-selection. The amendment should also clarify that compliance with disclosure duties does not affect the determination of employee status.

콜센터 위탁업체 등에서는 서류・면접전형을 통과한 구직자에게 수일에서 수주에 이르는 직무교육을 이수하게 한 뒤, 그 평가 결과에 따라 최종 채용 여부를 결정하는 방식을 활용하고 있다. 이에 따라 교육에서 탈락한 구직자의 노동법상 지위를 둘러싼 분쟁도 잇따르고 있다. 이 글은 최근 법원 판결과 노동위원회 판정례를 분석하여 근로계약관계의 성립 여부와 성립한 관계의 법적 성질에 관한 판단 구조를 규명하고, 현행법의 한계를 보완하기 위한 입법 과제를 검토한다. 법원 판결과 노동위원회 판정례를 분석하면, 교육 내용의 직무 밀착성, 교육 종료 후 즉시 실무에 투입되는지 여부, 시간적・장소적 구속과 근태 통제의 정도, 지급 금품의 성격 등이 근로계약관계 성립 판단의 주요 요소로 기능한다. 근로계약관계가 인정되는 경우에는 그 관계를 업무 적격성 평가를 위하여 해약권이 유보된 시용근로관계로 성질 결정할 수 있다. 그러나 판정례를 시간순으로 살펴보면 교육의 실질이 크게 달라지지 않았음에도 사업주의 사전 고지가 정교해질수록 구제신청이 기각되는 경향이 나타난다. 이러한 ‘고지에 의한 면책’ 구조는 버스 견습기사에 관한 서울행정법원 판결에서도 확인된다. 교육기간과 고지 내용은 모두 사용자가 설계할 수 있으므로 법해석만으로 보호의 공백을 해소하기 어렵다. 따라서 「채용절차의 공정화에 관한 법률」에 채용연계형 직업교육에 관한 구체적 고지 의무, 일정 시간을 초과하는 교육에 대한 대가 지급 의무, 채용 거부 시 서면통지 및 이유 제시 의무를 신설할 필요가 있다. 다만 고지 의무의 이행 여부가 근로자성 판단에 영향을 미치지 않는다는 확인 규정을 함께 두어야 한다.

인간다운 생활의 보장」은 이제 개인만의 문제가 아니며, 현대 모든 복지국가의 중요한 과제입니다. 우리나라도 국민의 복지향상을 위하여 건강보험·연금보험·산업 재해보상보험·고용보험등 사회보험분야에 사회보험법을, 또 국가유공자·공익행위자의 사회적 보상을 위하여 사회보상법을 제정·시행하고 있으며, 영세민의 기초생활보장과 장애인·노인·아동·여성등의 복지향상을 위하여 사회부조법·사회복지법 내지 사회복지서비스법을 제정·시행하고 있습니다. 그러나 우리나라의 사회법관련제도는 단기간의 외형적 급성장에도 불구하고, 그 역사가 비교적 짧으며, 아직도 초창기에 있습니다. 그 결과 무수한 법개정과 시행착오를 경험하지 않으면 아니되었으며, 현재에도 많은 문제점을 내포하고 있습니다. 그럼에도 불구하고 이 분야 법제도의 학문적·체계적 연구는 아직도 미흡한 실정입니다.
제도는 법을 통하여 생성·변경·소멸됩니다. 사회보험제도, 사회보상제도 및 사회복지제도도 예외가 아닙니다. 이러한 제도의 발달도 그 제도의 기초가 되는 사회법의 심도깊은 연구를 통하여 성취될 수 있습니다. 더구나 이 제도들은 복합적이고, 서로 연관되어 있는 경우가 허다하므로, 여러 전문가와 실무자의 통합적 접근이 필요합니다.
이에 이 분야의 전문지식과 실무경험을 가진 뜻있는 사람들이 모여 사회법과 사회법관련제도를 학문적·체계적으로 집중 연구하고자 합니다. 그로써 우리나라가 지향하고 있는 복지국가에의 길을 좀 더 단축시키는데 기여하고자 합니다. 역사는 단축시킬 수는 있어도 뛰어 넘을 수는 없기 때문입니다.
