대법원 전원합의체 판결 이후 통상임금 요건의 재검토 — 소정근로 대가성의 재구성 —
Reexamining the Requirements of Ordinary Wages after the Supreme Court's En Banc Decision — Reconstructing Consideration for Prescribed Work —
The Supreme Court's 2024 en banc decision abolished “fixedness,” which had been the core requirement in determining ordinary wages, and held that if an employee fully performs the prescribed work, wages paid regularly and uniformly are, in principle, ordinary wages even where a continued-employment condition is attached. However, if this is misread as the proposition that “any regular and uniform payment is an ordinary wage,” it results in even benefits unrelated to the valuation of prescribed work — such as employer contributions to personal pension plans, housing allowances, holiday travel allowances, and vacation allowances — being included in ordinary wages. Accordingly, this article reconstructs the concept of “consideration for prescribed work” and presents a standard that distinguishes between payments that evaluate job duties, skills, proficiency, and working environment (affirmative indicators) and payments whose direct cause is the employee's personal or social circumstances, reimbursement of actual expenses, or the occurrence of a specific event (negative indicators). It further undertakes a comparative-law review of Germany's doctrine of base pay, social allowances, and asset-formation support, and Japan's doctrine on allowances excluded from premium wages under its enforcement regulations, to substantiate the coherence of this standard, and by classifying continued-employment conditions into the claim-preservation type and the claim-generation type, demonstrates that although the determination of validity and the determination of ordinary-wage status are conceptually separate, the latter type functions as important indirect evidence in the determination of consideration. Through this, the article presents an interpretive basis for the non-ordinary-wage status of special-purpose allowances such as personal pension subsidies.

2024년 대법원 전원합의체 판결은 통상임금 판단의 핵심 요건이었던 ‘고정성’을 폐기하고, 근로자가 소정근로를 온전히 제공하면 재직조건이 부가되어 있더라도 정기적・일률적으로 지급되는 임금은 원칙적으로 통상임금이 된다고 판시하였다. 그에 따르면 통상임금은 근로기준법상의 법정수당을 산정하는 기준이므로, 그 본질은 근로자가 소정근로시간에 제공하기로 정한 근로의 가치를 평가한 기준임금이며, 정기성과 일률성은 그 임금이 소정근로의 대가인 임금임을 뒷받침하는 개념적 징표라고 보았다. 다만, 이 경우 소정근로의 대가성에 대한 구체적 해석을 도외시하고 ‘정기적・일률적 지급이면 모두 통상임금’이라는 명제로 오독하면, 개인연금 지원금・주택수당・명절귀성비・휴가비 등 소정근로의 가치 평가와 무관한 급부까지 통상임금에 산입되는 결과를 낳는다. 이에 본고는 ‘소정근로 대가성’ 개념을 재구성하여, 직무・기술・숙련・작업환경을 평가하는 급부(적극 징표)와 근로자의 개인적・사회적 상황, 실비 보전, 특정 사건의 도래를 지급원인으로 하는 급부(소극 징표)를 구별하는 판단기준을 제시한다. 아울러 독일의 기본임금・사회수당・자산형성지원 법리와 일본 시행규칙상 할증임금 제외 수당 법리를 비교법적으로 검토하여 그 정합성을 뒷받침하고, 재직조건을 청구권 존속형과 발생형으로 유형화함으로써 그 유효성 판단과 통상임금성 판단이 개념적으로 분리되면서도, 후자의 유형이 대가성 판단의 중요한 간접 사정임을 논증한다. 이를 통해 개인연금 지원금 등 특수목적 수당의 비통상임금성에 관한 해석론적 근거를 제시한다.

인간다운 생활의 보장」은 이제 개인만의 문제가 아니며, 현대 모든 복지국가의 중요한 과제입니다. 우리나라도 국민의 복지향상을 위하여 건강보험·연금보험·산업 재해보상보험·고용보험등 사회보험분야에 사회보험법을, 또 국가유공자·공익행위자의 사회적 보상을 위하여 사회보상법을 제정·시행하고 있으며, 영세민의 기초생활보장과 장애인·노인·아동·여성등의 복지향상을 위하여 사회부조법·사회복지법 내지 사회복지서비스법을 제정·시행하고 있습니다. 그러나 우리나라의 사회법관련제도는 단기간의 외형적 급성장에도 불구하고, 그 역사가 비교적 짧으며, 아직도 초창기에 있습니다. 그 결과 무수한 법개정과 시행착오를 경험하지 않으면 아니되었으며, 현재에도 많은 문제점을 내포하고 있습니다. 그럼에도 불구하고 이 분야 법제도의 학문적·체계적 연구는 아직도 미흡한 실정입니다.
제도는 법을 통하여 생성·변경·소멸됩니다. 사회보험제도, 사회보상제도 및 사회복지제도도 예외가 아닙니다. 이러한 제도의 발달도 그 제도의 기초가 되는 사회법의 심도깊은 연구를 통하여 성취될 수 있습니다. 더구나 이 제도들은 복합적이고, 서로 연관되어 있는 경우가 허다하므로, 여러 전문가와 실무자의 통합적 접근이 필요합니다.
이에 이 분야의 전문지식과 실무경험을 가진 뜻있는 사람들이 모여 사회법과 사회법관련제도를 학문적·체계적으로 집중 연구하고자 합니다. 그로써 우리나라가 지향하고 있는 복지국가에의 길을 좀 더 단축시키는데 기여하고자 합니다. 역사는 단축시킬 수는 있어도 뛰어 넘을 수는 없기 때문입니다.
