학생인가 노동자인가 : 미국 대학 스포츠 NIL–비자 분쟁과 이민 주권의 재구성
Student or Worker? The NIL–Visa Dispute in U.S. College Sports and the Reconfiguration of Immigration Sovereignty
Objectives This study analyzes a 2025 U.S. legal dispute over an international college athlete's visa classification, examining how NIL-era commercialization strains the residency categories of immigration law and how interpretive authority over that strain is distributed. Methods A qualitative single-case study combining process tracing and legal -institutional analysis was employed, framed by immigration sovereignty, the liminal migrant worker concept, and sport exceptionalism. Data include federal statutes and regulations, USCIS guidance, and NCAA NIL documents, covering July 2021 to September 2025. Results NIL expansion conflicts with the non-labor premise of the F-1 regime, while the P-1A route presents full-time student status itself as an obstacle to eligibility. International athletes thus face legal risk their domestic peers do not. The court denied the government's motion to dismiss, finding the disputed eligibility requirement warranted review on the full administrative record; it did not rule on NIL activity under F-1 or on P-1A eligibility for student athletes. Conclusions Immigration regulation appears sustained less by mechanical application of fixed categories than by ongoing interpretive adjustment, and highly visible migrants may face the same mechanism of categorical indeterminacy as low-wage workers, though not under the same conditions. Federal agencies should issue guidance differentiating NIL activity by type, legislative clarification of the P-1A purpose requirement is needed, and universities should establish integrated advisory channels.

본 연구는 2025년 미국에서 발생한 국제(외국 국적) 대학 학생선수의 체류 자격을 둘러싼 법적 분쟁을 대상으로, NIL(Name, Image, and Likeness) 제도 도입 이후의 대학 스포츠 상업화가 이민법상 체류 자격범주에 가하는 압력을 분석하였다. 구체적으로 국제 학생선수의 활동이 체류 자격 범주와 어떤 지점에서 불일치하며, 그 불일치를 둘러싼 해석 권한이 어떤 행위자들 사이에 배분되어 있는지를 검토하였다. 이를 위해 이민 주권론, 경계적 이주 노동자 개념, 스포츠의 예외성이라는 세 가지 이론적 축을 결합한 틀을 구성하고, 질적 단일 사례연구를 채택하여 과정 추적(process tracing)과 법제도 분석을 병행하였다. 연방법령 및 규정, USCIS의 행정 안내자료, NCAA의 NIL 관련 공식 문서, 해당 사건의 법원 문서를 1차 자료로 삼고, 학술문헌과 실무 해설 자료를 보완적으로 활용하였으며, 시간적 범위는 2021년 7월부터 2025년 9월까지로 설정하였다. 분석 결과, NIL 제도의 확대는 F-1 학생비자의 비노동적 체류 전제와 상충하는 한편, 운동선수를 위한 P-1A 체류자격에서는 전일제 학생 신분 자체가 요건 충족의 장애로 제시되어, 국제학생선수는 국내 선수와 상이한 법적 위험에 놓이는 것으로 나타났다. 법원은 정부의 각하신청을 기각하면서 다투어진 요건의 해석은 완전한 행정기록에 기초하여 본안에서 판단할 사항이라고 보았으나, F-1상 NIL 활동의 허용 여부나 학생선수의 P-1A 요건 충족을 판시한 것은 아니다. 결론적으로 이민 규제는 고정된 범주의 기계적 적용보다 지속적인 해석상 조정을 통해 유지되는 것으로 이해될 필요가 있으며, 고 가시성 이주자 역시 저임금 이주노동자와 동일한 조건은 아니되 범주적 불확정성이라는 동일한 기제에 노출될 수 있음을 시사한다. 정책적으로는 연방 행정기관의 NIL 활동 유형별 해석 지침 마련, P-1A 목적 요건에 관한 입법적 정리, 그리고 대학 차원의 통합적 정보 제공 체계의 마련이 요구된다.
