Computationalism in Cognitive Science and Criminal Legal Judgment : the Philosophical Foundations of Computational Law

Recent advances in generative AI and legal technology have intensified discussions of Computational Law, yet most focus on application, regulation, and automation, leaving its philosophical and cognitive-scientific foundations underexplored. To address this gap, human and criminal legal judgment are examined from the perspective of computationalism. Computationalism is understood not as an ontological claim identifying the mind with a machine, but as a methodological framework for analyzing judgment. Searle’s critique, connectionism, and predictive processing did not refute computationalism but broadened computation from rule-based processing to probabilistic and learning-based inference. From this perspective, criminal legal judgment is likewise an information-processing activity, and the free evaluation of evidence constitutes structured inference amenable to computational analysis. According to Marr’s three levels of analysis, the algorithmic level of judgment is formalizable, with its scope expanding alongside technological advances, whereas the computational level-its normative purpose-resists formalization because of the principled distinction between fact and norm. Computational Law can thus be reconceptualized not merely as an application of legal AI but as an extension of computationalism into legal scholarship, with Law-as-Code and Law-as-Data corresponding respectively to rule-based and probabilistic conceptions of computation.

최근 생성형 인공지능과 리걸테크의 발전으로 계산법학(Computational Law)에 관한 논의가 활발해지고 있으나, 기존 논의는 주로 적용, 규제 및 자동화에 집중하여 그 철학적·인지과학적 토대에 관한 탐구는 상대적으로 부족하였다. 이러한 공백을 보완하기 위해 계산주의(computationalism)의 관점에서 인간의 판단을 고찰하고 이를 형사법적 판단으로 확장한다. 계산주의는 인간의 마음과 기계를 동일시하는 존재론적 명제가 아니라 판단을 분석하기 위한 방법론적 관점으로 이해될 수 있으며, 설(Searle)의 비판, 연결주의(connectionism), 예측처리(predictive processing)는 계산주의를 반박한 것이 아니라 계산의 개념을 규칙 기반처리에서 확률적 ·학습 기반 추론으로 확장하였다. 이러한 관점에서 형사법적 판단 역시 정보처리 활동이며, 자유심증주의에 따른 증거평가는 계산적 분석이 가능한 구조화된 추론으로 이해할 수 있다. 또한 마(Marr)의 세 가지 분석 수준에 따르면 판단의 알고리즘 수준은 형식화가 가능하고 기술 발전에 따라 그 범위가 확대되는 반면, 판단의 규범적 목적에 해당하는 계산 수준은 사실과 규범의 원리적 구별로 인해 형식화에 한계가 있다. 이에 계산법학은 단순한 법률 인공지능의 응용기술이 아니라 계산주의가 법학의 영역으로 확장된 것으로 재해석될 수 있으며, 그 두 패러다임인 ‘Law-as-Code’와 ‘Law-as-Data’는 각각 규칙 기반 계산주의와 확장된 확률적 계산 개념에 대응함을 제안한다.
