This study aims to identify the legal and institutional measures needed to protect the human rights and self-determination of older persons, including those with cognitive impairment, in super-aged Korean society. It first examines the concepts of human rights, the rights of older persons, and self-determination. It then reviews the development of relevant international norms and domestic legal and institutional frameworks. The analysis is based on previous studies and relevant legislation.In medical and care settings, cognitive impairment is often regarded as evidence of a complete loss of decision-making capacity. The decisions of family members may also be given priority over those of the older persons concerned. Such practices can restrict the right of older persons to self-determination. However, older persons with cognitive decline may still be able to express their will and preferences and participate in decision-making. Their ability to do so may vary depending on the nature of the decision, the communication environment, and the support available. Therefore, decision-making capacity should be assessed separately for each specific decision rather than determined solely on the basis of a diagnosis or cognitive status. Appropriate support should also be provided, such as sufficient time, repeated explanations, plain language, visual materials, assistive devices, and assistance based on a relationship of trust. Based on this analysis, the study proposes standardized supported decision-making procedures for use in medical institutions and community-based care settings. These procedures should include an assessment of decision-making capacity, confirmation of the person’s will and preferences, documentation of the support provided, and review of the decision. An ongoing feedback system should also be established to determine whether additional support or reconsideration is needed. In addition, health care and care professionals should receive practical training in communication and conflict resolution. Family members should be regarded as supporters who help older persons express their wishes rather than as substitute decision-makers. At the community level, an integrated advocacy system should connect dementia care centers, integrated care support organizations, elder protection agencies, and legal aid institutions. Independent advocates should also be available when decisions may significantly affect the rights and daily lives of older persons.

본 연구는 초고령 한국 사회에 진입한 인지장애 노인을 포함한 노인의 인권과 자기결정권을 실질적으로 보장하기 위한 법·제도적 과제를 고찰하는 데 목적이 있다. 이를 위해 인권, 노인 인권 및 자기결정권의 개념과 상호관계를 살펴보고, 노인 인권에 관한 국제규범과 국내 법·제도의 전개 과정 및 주요 내용을 문헌과 관련 법령을 중심으로 분석하였다. 특히 의료 및 돌봄 현장에서 인지장애를 의사결정능력의 전면적 상실과 동일시하거나, 환자 본인보다 가족과 보호자의 판단을 우선하는 관행이 노인의 자기결정권을 제한할 수 있다는 점에 주목하였다. 인지기능이 저하된 노인이라도 의사결정의 내용과 복잡성, 의사소통 환경 및 지원의 정도에 따라 자신의 의사와 선호를 표현하고 결정 과정에 참여할 수 있으므로, 의사결정능력은 획일적으로 판단하기보다 구체적인 사안별로 평가되어야 한다. 또한 충분한 설명 시간, 반복적인 정보 제공, 이해하기 쉬운 표현과 시각 자료, 보조기기 및 신뢰 관계에 기반한 조력 등 합리적인 지원이 제공될 필요가 있다. 이에 본 연구에서는 의료기관과 지역사회 돌봄 현장에서 활용할 수 있도록 의사결정능력 평가, 당사자의 의사와 선호 확인, 지원 내용의 기록 및 결정 이후의 재평가를 포함하는 표준화된 의사결정지원 절차와 지속적인 환류 체계를 마련할 것을 제안하였다. 아울러 의료인과 돌봄 종사자의 의사소통 및 갈등 조정 역량을 강화하고, 가족의 역할을 대리결정자에서 당사자의 의사 표현을 돕는 조력자로 재정립할 것을 제안하였다. 더 나아가 지방자치단체의 지역사회 통합돌봄서비스 운영 주체, 치매안심센터, 노인보호전문기관 및 법률지원기관 등을 연계하고, 중대한 권리 관련 결정에는 독립적인 권익옹호자가 참여할 수 있는 지역사회 기반의 지원체계를 구축할 필요가 있다.
