This study aims to elucidate the dual nature of juvenile justice inherent in the structure of Japanese colonial rule by analyzing the establishment process and operational realities of the Gyeongseong Juvenile Court during the wartime regime. Japan had long adopted Western protective ideals of juvenile justice to address juvenile crime, but these were transformed into a mechanism of control when combined with the objectives of preventing recidivism and maintaining nationalistic order. This institutional character was directly projected onto colonial Chosun. In Chosun, demands for the establishment of juvenile courts had been continuously raised since the 1920s; however, the Japanese Government-General of Chosun delayed these efforts, citing reasons such as budget shortages, and instead resorted to temporary measures such as establishing special trial chambers within local courts. This demonstrated the limitations of colonial rule, which viewed juvenile offenders as subjects of punishment rather than seeking to establish a juvenile justice system centered on protective measures. However, as the wartime regime intensified after 1937, discussions on enacting a Juvenile Act and establishing juvenile courts also gained momentum, and it was not until 1942 that the enactment of the “Chosun Juvenile Ordinance” and the establishment of the Gyeongseong Juvenile Court finally became a reality. Although the Gyeongseong Juvenile Court ostensibly promoted the protection of juveniles, in practice, it functioned as a mechanism for mobilizing labor and controlling ideology through protective dispositions. The court imposed protective dispositions, such as placement in reformatories, on juveniles brought before it; consequently, juveniles admitted to these facilities were required to provide labor under the guise of vocational training, alongside education aimed at turning them into subjects of the Empire. Furthermore, some were incorporated into the “industrial warrior” program and mobilized for forced labor. Consequently, while the Gyeongseong Juvenile Court took on the outward appearance of a modern juvenile justice system emphasizing protection and reform, it essentially served as a mechanism to integrate colonial youths into the wartime mobilization system.

본 연구는 전시체제기 경성소년심판소의 설치 과정과 운영 실태를 분석하여 일제 식민통치 구조에 내재된 소년사법의 이중적 성격을 규명하는 것을 목적으로 한다. 일본은 일찍이 서구의 보호주의적 소년법을 수용하여 소년범죄 문제 해결을 도모하였으나, 이는 재범 방지와 국가주의적 질서 유지라는 목적과 결합되며 통제 장치로 변용되었고, 이러한 제도적 성격은 식민지 조선에도 그대로 투영되었다. 조선 역시 1920년대 이후 소년심판소 설치 요구가 지속적으로 제기되었으나, 조선총독부는 예산 부족을 이유로 이를 지연시키는 한편 지방법원 내 특별공판정 설치라는 임시적 대응으로 소년 범죄문제를 해결하고자 했는데, 이는 보호처분 중심의 소년사법 체계를 구축하기보다는 소년범을 처벌 대상으로 인식했던 식민 통치의 한계를 보여주는 것이었다. 그러나 1937년 이후 전시체제가 강화되면서 소년법 제정 및 소년심판소 설치 논의 역시 본격화되었고, 1942년에 비로소 「조선소년령」 제정과 경성소년심판소 설치가 현실화되었다. 경성소년심판소는 표면적으로는 소년 보호를 내세웠으나, 실제 운영에서는 보호처분을 매개로 한 노동력 동원과 사상 통제를 하는 장치로 기능하였다. 경성소년심판소는 재판정에 세워진 소년들에 대해 감화원 등으로 ‘보호 처분’하였고, 이로 인해 보호시설에 수용된 소년들은 황국신민화 교육과 함께 직업훈련을 명목으로 노동력을 제공해야 했다. 더 나아가 일부는 산업 전사로 편입되어 강제 노동에 동원되어야 했다. 결과적으로 조선에 설치한 소년심판소는 보호와 교화를 내세운 근대적 소년사법 제도의 외형을 취하면서도, 실질적으로는 식민지 소년들을 전시 총동원 체제에 편입시키기 위한 장치로 기능하였다.

본 학회는 1983년에 조직되어 한국사, 동양사, 서양사, 역사이론, 고고학, 미술사, 과학사 등 역사학과 인접학문의 우수한 논문을 폭넓게 소개하여 역사학 연구자들의 연구역량을 강화하고 회원 상호간의 긴밀한 교류의 장을 만들고자 조직하였다. 숭실사학회에서는 정기적인 학술발표 지속적으로 개최해 왔으며, 연 1-2회에 걸쳐 학술지 '숭실사학'을 발간해 왔다. 앞으로도 숭실사학회에서는 회원들의 연구 활동이 꾸준히 이루어질 수 있도록 노력할 것이며, 보다 정기적인 학술강연회 및 월례발표, 단행본의 출간, 및 답사활동 등을 통해 보다 내실 있는 학회활동이 이루어질 수 있도록 최선을 다하고자 한다.
