Taking Level 5 (L5) fully autonomous driving technology as a starting point, this paper systematically explores the theoretical justification and institutional design for treating strong artificial intelligence (AI) as a subject of criminal liability. As autonomous driving evolves toward full-scenario independent decision-making, the self-generated risks of strong AI—driven by algorithmic black boxes and deep learning—substantially sever the causal links in traditional criminal law. Facing the absence of a liable subject caused by this technological shift, forcibly applying traditional rules to punish passengers who cannot intervene or manufacturers who have met compliance standards would create a legal dilemma. It would violate the principle of culpability and lead to liability without subjective fault. To fill this liability gap, this paper argues for breaking away from the humancentric biological focus of traditional criminal law. Instead, it shifts the foundational basis of criminal liability to a substantive “ability to respond to legal norms.” Within specific operational domains, strong AI entities already possess the ability to recognize and control their actions in a criminal law sense. Therefore, granting them an independent status as subjects of criminal liability is a necessary choice to prevent risks and avoid the collapse of the liability system. Building on this theoretical foundation, this paper innovatively reconstructs a penal system tailored to the characteristicsof digital subjects. It proposes exclusive punishment measures such as the “digital death penalty,” “qualification downgrade,” and “mandatory sandbox retraining.” This system not only effectively removes the capacity to re-offend at the foundational code level, but also aligns with the resocialization function and general prevention goals of criminal punishment. Ultimately, it provides solid jurisprudential support for the healthy development of the autonomous driving industry and the protection of legal interests in the digital age.

본 논문은 레벨 5(L5) 완전 자율주행 기술을 출발점으로 삼아, 강인공지능을형사책임 주체로 인정하기 위한 이론적 타당성과 제도 구축 방안에 대해 체계적으로 고찰하였다. 자율주행이 모든 상황에서 스스로 의사를 결정하는 단계로 발전함에 따라, 알고리즘 블랙박스와 딥러닝을 기반으로 강인공지능이 스스로 생성한 위험은 기존 형법상의 인과관계를 실질적으로 단절시킨다. 이처럼기술이 고도로 발전함에 따라, 책임 주체가 부재한 상황에서, 개입 능력이 없는 탑승자나 규범 준수 의무를 다한 제조사에게 무리하게 기존의 귀책 방식을적용한다면, 이는 책임주의 원칙에 위배되고 객관적 결과책임을 묻게 되는 법리적 모순에 빠지게 된다. 이러한 귀책의 공백을 메우기 위해, 본 논문에서는기존 형법의 인간 생물학적 중심주의에서 벗어나 형사책임의 존재론적 기초를실질적인 규범 반응 능력으로 전환할 것을 주장한다. 특정 운행 영역 내에서강인공지능은 이미 형법이 요구하는 사물 변별 및 행위 통제 능력을 갖추고있으므로, 이에 독립적인 형사책임 주체 지위를 부여하는 것은 위험을 방지하고 귀책 체계의 붕괴를 막기 위한 필연적 선택이다. 이러한 이론적 기초에서, 본 논문은 디지털 주체의 특성에 부합하는 형벌 체계를 새롭게 재구성하여 디지털 사형, 자격 강등, 샌드박스 강제 재학습 등 맞춤형 처벌 방안의 적용을제안하였다. 이 체계는 시스템의 기본 코드 논리에서 재범 능력을 효과적으로박탈할 수 있을 뿐만 아니라, 형벌의 재사회화 기능 및 일반예방 목적에도 부합한다. 결과적으로 이는 디지털 시대 자율주행 산업의 건전한 발전과 법익 보호를 위한 탄탄한 법리적 기반을 제공할 것이다.
