Live commerce is a form of e-commerce in which real-time video, product explanations, recommendations, user interaction, ordering, payment, and post-transaction dispute resolution are integrated within a single platform environment. In this structure, multiple actors, including sellers, live-room operators, live-marketing personnel, service institutions, and platforms, participate, and liabilities concerning product defects, misleading representations, endorsements, payment, refunds, and dispute resolution may be fragmented across different legal relationships. At the same time, key materials necessary for dispute resolution, such as broadcast records, order information, payment data, customer service logs, and refund or exchange records, tend to be concentrated in or around the platform. The central issue, therefore, is not whether platforms should be deemed sellers, but what management duties they bear within the scope of their organizational and procedural control, and how violations of such duties are translated into liability. China’s Measures for the Supervision and Administration of Live-StreamingE-Commerce institutionalize this issue within a regulatory framework tailored to live commerce. The Measures distinguish among platform operators, live-room operators, live-marketing personnel, and service institutions as functionally differentiated duty-bearing subjects. They impose staged duties on platform operators, including pre-transaction identification and risk classification, real-time monitoring and intervention during live commerce, and post-transaction preservation of transaction data, cooperation in dispute resolution, and cooperation with regulatory authorities. Importantly, violations of these duties are linked to liability mechanisms under the E-Commerce Law, the Regulation on the Implementation of the Law on the Protection of Consumer Rights and Interests, as well as supplementary sanctions within the Measures themselves. This framework does not impose general guarantee liability for transaction outcomes. Rather, it establishes conduct-based, staged management duties corresponding to the platform’s functional controllability and connects them to structured mechanisms of liability enforcement. Korean e-commerce law also provides various regulatory tools capable of addressing risks arising from live commerce. These include intermediary liability under the E-Commerce Consumer Protection Act, the Fair Labeling and Advertising Act, endorsement and testimonial guidelines, duties to preserve transaction records, consumer dispute resolution mechanisms, and civil liability. However, these tools are dispersed across different legal categories and actors, including intermediaries, sellers, endorsers, live streamers, and MCNs. They are not yet sufficiently organized into a coherent structure that links the platform’s functional controllability with duty-bearing subjects, stages of management, preservation of transaction data, cooperation in dispute resolution, and mechanisms of liability enforcement. Thus, the key difference between the Chinese and Korean frameworks lies not in the existence of regulatory tools, but in how functional controllability connects the layer of management duties with that of liability enforcement. This comparison suggests that the Korean legal framework should not adoptChina’s specialized regulatory structure for live commerce wholesale. Rather, it should pursue selective systematization within its existing, functionally differentiated structure. At the interpretative level, duties of notice and information provision imposed on intermediaries, as well as civil-law duties of care, may be specified in light of the platform’s actual scope of control. At the level of subordinate regulation, more concrete standards may be developed regarding in-stream advertising and endorsements, disclosure of economic interests, order-stage information, and preservation of disputerelated data. Where necessary, legislative supplementation may clarify staged duties concerning pre-transaction identification, real-time risk management, and post-transaction data preservation and dispute cooperation. Such developments should be grounded not in general monitoring obligations or a blanket attribution of seller status, but in a structured framework of staged management duties and liability enforcement based on the platform’s awareness, capacity to act, and actual scope of control.

라이브커머스는 실시간 영상, 상품 설명, 추천, 이용자 상호작용, 주문·결제및 사후 분쟁처리가 하나의 플랫폼 환경 안에서 결합되는 전자상거래 방식이다. 이러한 거래구조에서는 판매자, 라이브방 운영자, 라이브마케팅 인력, 서비스기관 및 플랫폼 등 복수의 주체가 관여하며, 상품 하자, 허위·과장 설명, 추천·보증, 결제, 환불 및 분쟁처리 책임이 서로 다른 법률관계로 분산될 수있다. 반면 방송기록, 주문정보, 결제자료, 상담기록 및 환불·교환 기록 등 분쟁해결에 필요한 자료는 플랫폼 또는 그와 연결된 사업자에게 집중되는 경향이 있다. 따라서 라이브커머스에서 문제되는 플랫폼 책임의 핵심은 플랫폼을판매자로 의제하는 데 있는 것이 아니라, 플랫폼이 거래공간과 정보흐름 및 절차를 조직·통제하는 범위에서 어떠한 관리의무를 부담하며 그 위반이 어떠한구조를 통해 책임으로 실현되는지를 밝히는 데 있다. 중국 「直播电商监督管理办法」은 이러한 문제를 라이브커머스에 특화된규범구조 안에서 제도화한다. 이 규정은 라이브커머스 플랫폼 사업자, 라이브방 운영자, 라이브마케팅 인력 및 라이브마케팅 종사자 서비스기관을 기능별의무주체로 구분하고, 플랫폼 사업자에게 사전 식별·등록 및 위험분류, 진행중 위험 모니터링과 위법행위 차단, 사후 거래정보 보존과 분쟁처리 협조 및감독기관 협력의무를 단계적으로 부과한다. 나아가 이러한 관리의무 위반을 「 전자상거래법」, 「소비자권익보호법 실시조례」상 책임 또는 부문규장 자체의보충적 제재로 연결함으로써, 라이브커머스 특화 부문규장이 의무설정층과 책임실현층을 잇는 매개규범으로 기능하도록 한다. 이는 플랫폼에게 거래결과전반에 대한 보증책임을 부과하는 것이 아니라, 플랫폼의 기능적 통제가능성에상응하는 행위규범으로서의 단계적 관리의무와 그 위반에 따른 책임실현 구조를 제도화한 것으로 이해할 수 있다. 한국 전자상거래법제 역시 라이브커머스에서 발생하는 위험에 대응할 수 있는 다양한 규율수단을 갖고 있다. 전자상거래법상 통신판매중개자 책임, 표시·광고법, 추천·보증 심사지침, 거래기록 보존의무, 소비자분쟁 처리제도및 민사상 손해배상책임은 관련 문제를 일정 부분 포섭한다. 다만 이러한 규율수단은 통신판매중개자, 판매자, 추천·보증인, 쇼호스트 및 MCN 등 다양한주체와 법범주에 분산되어 있으며, 라이브커머스 플랫폼의 기능적 통제가능성을 매개로 의무주체,한국법은 라이브커머스 위험에 대응할 수 있는 관련 규율수단을 갖추고 있으나, 이들 수단은 통신판매중개자, 판매자, 추천·보증인, 쇼호스트 및 MCN 등 다양한 주체와 법범주에 분산되어 있고, 라이브커머스 플랫폼의 기능적 통제가능성을 매개로 의무주체, 관리단계, 거래정보 보존 및 분쟁처리 협조, 책임실현 방식이 하나의 구조로 충분히 연결되어 있다고 보기는 어렵다. 따라서 한중 법제의 차이는 규율수단의 존재 여부가 아니라, 플랫폼의기능적 통제가능성이 관리의무의 설정과 책임실현 구조를 연결하는 방식에서나타난다. 이러한 비교는 한국법상 정합화 방향이 중국의 라이브커머스 특화 규범구조를 직접 수용하는 데 있지 않음을 시사한다. 현행법 해석론 차원에서는 통신판매중개자의 고지·정보제공의무와 민사상 주의의무를 플랫폼의 실제 통제범위와 연계하여 구체화할 필요가 있다. 또한 하위규범 차원에서는 방송 중 표시· 광고, 추천·보증, 경제적 이해관계 표시, 주문시점 정보 및 분쟁관련 자료 보존 기준을 보다 명확히 할 수 있다. 필요한 경우 입법적 보완을 통해 플랫폼의사전 식별, 진행 중 위험관리, 사후 자료보존 및 분쟁처리 협조 의무를 단계적으로 정비할 수 있다. 다만 이러한 정비는 일반적 감시의무나 판매자 의제에기초하는 것이 아니라, 플랫폼의 인식가능성, 조치가능성 및 실제 통제범위에대응하는 단계적 관리의무와 책임실현 구조의 체계화를 지향하여야 한다.
