Against the backdrop of the rapid development of digital healthcare and the growing value of data, the cross-border transfer of health and medical data has become a crucial foundation for promoting international medical cooperation and medical innovation. However, such data are characterized by high sensitivity and public interest attributes, and their cross-border transfer entails complex legal risks and regulatory challenges. This paper takes China’s regulation of cross-border transfers of health and medical data as its research object and conducts a systematic analysis from the perspectives of legal foundations, institutional status, practical limitations, and optimization pathways. The study finds that China has preliminarily established a multi-level regulatory framework centered on data security, personal information protection, and cybersecurity, and has formed multiple compliance pathways based on security assessment, standard contracts, and personal information protection certification mechanisms. Nevertheless, legal issues remain, including fragmentation of the regulatory system, legal uncertainty arising from the complexity of regulated objects and subjects, and structural imbalance among compliance pathways. In response, this paper proposes to promote the integration of regulatory rules and unified legislation, construct a dynamic regulatory mechanism based on risk orientation and hierarchical classification, and improve a collaborative compliance system among multiple stakeholders in the healthcare sector. These measures aim to achieve a dynamic balance among data security, personal information protection, and the development of the digital healthcare industry.

디지털 의료의 급속한 발전과 데이터 가치의 지속적인 증대로 인해 건강의료 데이터의 국경 간 이전은 국제 의료 협력과 의료 혁신을 촉진하는 핵심 기반으로 자리잡고 있다. 그러나 건강의료 데이터는 고도의 민감성과 공공성을 동시에 지니고 있어 국경 간 이전 과정에서 복잡한 법적 위험과 규제 문제에 직면하게 된다. 본 연구는 중국의 건강의료 데이터 국경 간 이전 규제에 관한 법규범을 연구 대상으로 삼아, 그 법적 근거, 제도적 현황, 현실적 한계 및 개선 방안을 체계적으로 분석한다. 연구 결과, 중국은 데이터 보안, 개인정보 보호, 사이버 보안을 중심으로 다층적인 규제 체계를 구축하였으며, 안전평가, 표준계약 및 개인정보 보호 인증 등의 메커니즘을 바탕으로 다양한 준수 경로를 마련한 것으로 나타났다. 그러나 규범 체계의 파편화, 규제 대상과 주체의 복잡성으로 인한 법 적용의 불확실성, 준수 경로 간 구조적 불균형 등 해결해야 할 법적 문제가 여전히 존재한다. 이에 본 연구는 규범 체계를 통합하고 통일적 입법을 촉진하며, 위험 기반의 분류⋅등급화에 따른 동태적 규제 메커니즘을 구축하고, 의료 분야의 다양한 이해관계자 간 협력적 규제 준수 체계를 개선함으로써 데이터 보안, 개인정보 보호 및 디지털 의료산업 발전 간의 균형을 실현할 것을 제안한다.
