연명의료중단 결정과 의사의 형사책임에 관한 고찰 - 미성년자의 자기결정권을 중심으로 -
A Study on the Withdrawal of Life-Sustaining Treatment and Criminal Liability of Physicians - Focusing on the Self-Determination Rights of Minors -
This study examines the limitations of minors’ self-determination rights in decisions regarding the withdrawal of life-sustaining treatment and the issue of physicians’ criminal liability. The current Act on Decisions on Life-Sustaining Treatment is primarily structured around adult patients, resulting in limited reflection of minors’ intentions in the decision-making process. In particular, concerns over criminal liability may lead medical professionals to adopt defensive medical practices, thereby further restricting minors’ rights to self-determination. To address these issues, this study analyzes the Japanese system of end-of-life decision-making from a comparative legal perspective and proposes several improvements, including the formalization of procedures for reflecting minors’ intentions, the introduction of a shared decision-making model, and the establishment of consistency between life-sustaining treatment decisions and the criminal law system.

현행 연명의료결정법은 성인의 경우 자기결정권이라는 헌법적 권리를 근거로 연명의료중단의 정당성이 논의될 수 있다. 그러나 미성년자의 경우에는 자기결정능력이 제한되거나 법적으로 충분히 인정되지않는 경우가 많다. 결국 미성년자에 대한 연명의료중단은 환자 본인의 자기결정이라기보다는 보호자와의료진에 의한 타인결정의 성격을 가지게 된다. 그러나 타인의 의사(意思)에 의한 생명권 침해를 정당화할 수 있는지에 대해서는 엄격한 검토가 필요하며, 현행법 어디에도 부모 또는 법정대리인에게 미성년자의 생명권 처분권까지 부여하고 있다고 볼 명시적 근거는 존재하지 않는다. 따라서 미성년자에 대한연명의료중단은 단순히 보호자의 의사에 의하여 결정될 문제가 아니라, 미성년자의 생명권 보호라는관점에서 보다 엄격한 요건과 절차 아래 이루어질 필요가 있다.
