In 2022, Japan amended the Act on Penal Detention Facilities and the Treatment of Inmates and Detainees and newly introduced a system under which the feelings and perspectives of victims are taken into consideration in correctional treatment and correctional education at the correctional stage. At the same time, the system allows authorities to hear the victims’ sentiments and convey them to the inmates concerned. The significance of this system lies in that it expands the previously passive involvement of victims—traditionally concentrated at the stages of investigation and trial—into active participation at the correctional stage. In this sense, it enables victims to exercise their rights directly or indirectly across all stages of the criminal justice process. Until now, there have been few, if any, provisions at the correctional stage addressing the relationship between offenders and victims or their respective roles, and even where such provisions existed, their scope was extremely limited. As a legal provision suggesting that an offender serving a sentence should be mindful of the relationship with the victim, Article 69 (Matters for Classification Investigation) of the Enforcement Regulations of the Act on the Execution of Sentences provides that, during the initial classification assessment, an investigation shall be conducted into the offender’s efforts to restore the harm caused by the crime and the extent of such efforts. However, this provision is not intended for the protection of victims; rather, it constitutes merely one element of the investigative process carried out for the purpose of determining appropriate correctional treatment for the inmate. Thus, the correctional system has not traditionally placed emphasis on institutional arrangements focusing on the relationship between offenders and victims, or on the protection and support of victims. This situation is related to the structural characteristics of corrections. In particular, corrections, by their very nature, place greater emphasis on the offender’s perspective. In other words, the fundamental principles of corrections—namely the rehabilitation, reformation, and social reintegration of inmates— inevitably result in the consequences of the criminal act or the victim’s perspective being relegated to a secondary position in the main discourse. In general, if offenders are left without receiving any specific education regarding the consequences of their actions, they may fail to understand the devastating impact their conduct has had on victims and society, or they may simply choose not to confront it. However, it is questionable whether allowing offenders to return to society merely because time has passed—without a proper understanding of the impact of their actions on victims and society—can truly be regarded as genuine rehabilitation. The most important starting point in the process of rehabilitation is for offenders to accurately recognize the consequences of their actions and to sincerely reflect on the harm inflicted upon victims and society. Such recognition and reflection should naturally constitute the foundation of correctional reform. In this respect, Japan’s correctional treatment system that takes into account the feelings of victims can be regarded as consistent with the fundamental objective of corrections: the rehabilitation and reform of inmates and their eventual reintegration into society. Once a trial has concluded, the judicial determination formally comes to an end. However, from the victim’s perspective, the case is not truly over; rather, it has merely moved from the trial stage to the correctional stage, which involves the execution of the sentence. In this sense, the judicial process concerning the offender continues. Accordingly, victims may wish to remain involved in the process as parties to the case even during the correctional stage. The system that takes into account the feelings and perspectives of victims in correctional treatment and correctional education transforms the status of victims from participants in procedures prior to the finalization of the sentence to participants who may be involved in correctional treatment after the sentence has been finalized. Even if victims do not occupy a central position at the correctional stage, they should not be entirely disregarded. It is also highly important that victims, as parties to the case, continue to be informed—even at the correctional stage, which represents the final phase of the criminal justice process—about how the offender’s feelings may have changed upon receiving the victim’s sentiments, whether the offender has developed a sense of remorse and apology, and how the offender is changing through the implementation of correctional treatment and related programs.

2022년 일본은 형사수용시설 및 피수용자 등의 처우에 관한 법률의 개정으로 새롭게 교정단계에서피해자의 심정 등을 교정처우와 교정교육에 고려하도록 함과 동시에 피해자의 심정 등을 청취하여 해당심정을 수용자에게 전달하는 제도를 도입하였다. 이 제도는 종래 수사나 재판단계에 집중되었던 피해자의 형사절차에의 소극적인 관여를 교정단계에서의 적극적인 관여로까지 확대한 것으로 형사절차의 모든영역에서 직·간접적으로 피해자의 권리를 행사하게 되었다는 점에 그 의의가 있다. 지금까지 교정 단계에서 가해자와 피해자의 관계 혹은 각각의 역할과 관련된 규정은 없었거나 혹은 있었다고 하여도 매우낮았다. 법률 규정으로 가해자인 수형자가 피해자와의 관계를 의식하고 있는 것으로 보이는 규정은 형집행법 시행규칙 제69조(분류조사 사항)에서 신입심사를 할 때에 범죄 피해의 회복 노력 및 정도에 대한조사가 이루어지도록 하고 있으나, 이 규정은 피해자 보호와는 관계없는 단지 수형자의 교정 처우를위해 이루어지는 조사 과정 중 하나의 요소에 불과한 것이다. 이처럼 교정에서는 가해자와 피해자의관계나 피해자 보호와 지원 등에 초점을 둔 제도 등은 의식하고 있지 않은데, 그 이유는 교정의 구조적인측면과 관계된다. 예컨대, 교정은 성격상 가해자 측면이 중시된다는 점이다. 즉, 수형자의 교정 교화와재사회화라는 교정 이념은 필연적으로 행위에 따른 결과 또는 피해자에 대한 관점은 주요 논점에서밀리게 된다. 일반적으로 가해자는 자신의 행위 결과에 대한 특별한 교육이 이루어지지 않고 그대로 방치한다면 자신의 행위가 피해자와 사회에 어떤 참혹한 결과를 가져왔는지 알 수 없고, 아니 굳이 알려고 하지 않는다. 그러나 자신의 행위가 피해자와 사회에 끼친 영향 등을 제대로 이해하지 못한 체, 시간이 지났다는 이유로 사회로 그대로 복귀하는 것이 진정한 의미에서 개선교화라고 할 수 있는지는 의문이다. 개선교화에서 가장 중요한 것은 자신의 행위 결과를 정확히 인식하고 진심으로 피해자와 사회에대해 반성하는 것이 그 출발점이며 당연히 그래야만 한다. 이러한 의미에서 일본의 피해자 심정을 고려한 교정처우제도는 교정 목적인 수형자의 교정 교화와 개선에 따른 사회복귀라는 이념에 합치된다. 재판이 종료되면 사법적 판단은 함께 종료한다. 하지만 피해자로서는 사건이 종료된 것이 아니라 단지 재판에서 형벌집행단계인 교정 단계로 이전된 것으로 가해자에 대한 사법절차는 계속되고 있다. 따라서 피해자는 교정 단계에서도 사건의 당사자로서 절차에 관여하기를 희망할 수 있다. 교정처우 및 교정교육에서의 피해자의 심정 등의 고려하는 제도는 피해자의 지위를 형의 확정 이전의 절차에 참여하는 지위에서확정된 이후의 교정처우에 관여하는 지위로 변화시키는 제도이다. 교정 단계에서의 피해자는 중심적인지위가 아니더라도 완전히 무시돼서는 안 된다. 피해자 감정의 전달로 가해자가 어떠한 심정 변화와사죄의 마음을 갖게 되고 있는지, 그리고 교정 처우 등의 실시에 따라 가해자가 어떻게 변화하고 있는지등의 과정을 사건의 당사자인 피해자가 형사절차의 마지막 단계인 교정에서도 계속 전달받을 수 있도록하는 것 또한 매우 중요하다.
