Reformulating the Transfer Rules for Game Accounts under the GaaS Model : From the Perspective of Rights Bundles Theory
권리묶음 이론의 관점에서 본 GaaS 모델하 게임 계정 양도 규칙의 재구성
As the Games as a Service (GaaS) model has become the dominant paradigm of the online gaming industry, game accounts have evolved from simple authentication credentials into complex digital objects embodying contractual, proprietary, and personality interests. Existing theories, including the property rights theory, creditor’s rights theory, and novel property theory, remain constrained by single-characterization approaches and are unable to adequately explain the pluralistic and dynamic nature of GaaS-based accounts. Drawing upon the bundle-of-rights theory, this article reconceptualizes game accounts as composite structures consisting of service claims, proprietary incidents, and personality interests. On this basis, it argues that account transfers should not be governed by the traditional binary framework of absolute prohibition or unrestricted transferability, but rather by differentiated rules corresponding to the distinct rights embedded within accounts. Service claims may remain subject to reasonable operator control, proprietary interests should enjoy qualified transferability, and personality interests should generally remain non-transferable. The article further proposes strengthening judicial review of transfer restrictions, establishing official account transfer mechanisms, protecting digital identity information, and developing a bundle-of-rights adjudicatory framework. Through these reforms, a more coherent legal regime can be established to balance the interests of users, operators, and transferees while responding to the realities of digital property in the GaaS era.

‘게임 서비스화(GaaS, Game as a Service)’ 모델이 온라인 게임 산업의 주류로 자리 잡으면서 게임계정은 단순한 서비스 로그인 증표에서 다원적 권익을 담은 복합적 권리 객체로 진화하였다. 현행법 상의 규제는 이에 현저히 뒤처져 있어 계정 양도 분쟁의 재판 기준이 분화되고, 계정 증여제도가 공백 상태이며, 사업자의 계정 정지 절차에 대한 구속력이 부족한 등 각종 문제가 잇따라 발생하고 있다. 기존의 물권설, 채권설, 신재산권설은 모두 단일 성격 규정 사고에 갇혀 GaaS 모델 하 게임 계정의 동태성과 복합성이라는 내재적 특성에 부응하기 어렵다. ‘권리묶음(bundle of rights)’ 이론을 도입하면, 상기에서 언급한 딜레마를 타개하는 데 유리하다. 이에 GaaS 모델 게임계정의 법적 지위를 세 가지 차원에서 체계적으로 재구성할 수 있다. 계약 차원에서 계정은 이용자가 서비스 약정에 기반해 사업자에게 게임 서비스의 지속적 제공을 요구할 수 있는 청구권을 담고 있다. 재산권 차원에서 이용자는 사용권, 수익권, 제한적 처분권을 향유하며, 서비스 계약과 독립된 재산적 권익을 구성한다. 인격권 차원에서 계정은 양도할 수 없는 인격적 이익을 보유한다. 상기 삼중 지위 확립은 현실적 분쟁해결에 구조적 분석 도구를 제공한다. 양도 분쟁은 계약·재산·인격 3차원으로 나누어 표준 약관의 효력을 심사해야 한다. 양도 문제는 재산적 권리와 인격적 내용을 구분해 각각 처리해야 한다. 제도 완성 차원에서는 입법이 가상재산 권능 규칙과 디지털 유산 상속 제도를 구체화하고, 사법은 권리 묶음 재판 프레임워크를 확산하며, 규제 기관은 이용자 약정 모범 표준 제정을 추진해야 한다. 개정된 본문은 특히 약관규제법상 불공정 약관 심사, 개인정보보호법상 개인정보 처리 및 익명화·가명화 기준, 그리고 디지털 자산의 독립적 이전 및 상속 문제를 함께 고려하여 제도화 방안을 보완하였다.

전북대학교 동북아법연구소는 동북아법에 관한 국내외의 이론과 실제를 연구하고 교육하며, 그 결과를 발표하여 동북아법에 대한 이해의 증진과 동북아의 법률문화발전에 기여하기 위한 목적으로 2006년 7월 설립되었다.
서해안시대의 중심지역을 표방한 전라북도의 지리적 여건과 동북아시아의 여러 국가와의 인적 물적 교류가 확대되면서 그에 따른 여러 가지 법률문제가 발생됨에 따라 동북아시아의 지역적 특성을 고려한 법제도의 연구와 이들 국가와 거래하는 전북지역 자치단체와 기업에 대한 실질적 교육의 필요성이 대두되었다.
이러한 요청에 따라 법제도의 연구와 교육을 담당할 기관으로 전북지역 거점국립대학인 전북대학교가 동북아법연구소를 설립하게 되었고 전북 지방자치단체와 기업에 대한 교육과 자문프로그램을 운영하고 있다.
