Currently, unmanned aerial vehicle (UAV)-based logistics delivery has become commonplace across major Chinese cities such as Shenzhen and Shanghai. However, drones continuously collect various data while flying over residential areas. Their hovering over neighborhoods, close-range shooting and peeping behaviors undermine residents’ peaceful lives and steal personal information, making privacy infringement an increasingly prominent issue. According to a 2023 report released by the China Consumers Association, privacy violations accounted for 37% of all drone-related complaints, representing a sharp year-on-year increase. China’s current legal system struggles to effectively address these problems. The Civil Code contains no prohibitions on continuous data collection, and the Personal Information Protection Law sets exceptions to privacy protection, which makes it inapplicable to drone-related privacy infringements. In addition, laws and regulations on low-altitude flight focus primarily on flight safety, lacking specific provisions on privacy protection or containing only overly general rules. Poor coordination, inconsistent application criteria and fragmented legal provisions further hinder administrative supervision and legal remedies. Complicated liability subjects and algorithmic black boxes also make it difficult to identify infringements and determine fault, leaving victims with limited means to seek redress. To tackle privacy infringements caused by logistics drones, this study puts forward targeted improvement measures in five aspects: legislation, governance, technology, supervision and legal remedy. These proposals can ensure the orderly development of the low-altitude economy and build a solid safeguard for Chinese citizens’ right to privacy.

현재 중국은 선전과 상하이 등 대도시를 중심으로 드론(UAV)을 이용한 물류 배송이 일상적으로 이루어지고 있다. 하지만 드론이 주거지역을 경유하면서 각종 데이터를 지속적으로 수집하는 등 개인 프라이버시 침해 문제가 점점 더 두드러지고 있다. 드론에 의한 프라이버시 침해는 주거지역을 선회하면서 근접촬영이나 엿보기 등으로 주민의 평온한 생활과 개인정보를 수집하는 것들로, 2023년 중국소비자협회 보고서에 따르면, 무인기 관련 민원 중 프라이버시 침해율이 37%에 달하면서 전년 대비 크게 증가했다. 하지만, 중국의 현행 법체계로는 이러한 문제를 효과적으로 대응하기 쉽지 않다. 민법전은 지속적 데이터 수집에 관한 금지규정이 없으며, 개인정보보호법도 특별한 경우에 대하여는 프라이버시 보호가 제한되기 때문에 드론의 사생활 침해에 대하여 직접 적용하기 어렵다. 또 저고도 비행 관련 법규는 비행 안전에 중점을 두어 프라이버시 보호 조항이 부재하거나 지나치게 일반적이다. 이처럼 관련법 간 연계성의 부족, 적용기준의 불일치, 적용법률의 분산화 등으로 법적 구제와 행정감독에 많은 어려움이 있는 것이 사실이다. 특히, 드론으로 인한 프라이버시권 침해는 다수의 책임주체와 알고리즘 블랙박스 등 입증이나 과실의 판정을 어렵게 하여 피해자 구제가 어렵다. 이에 본 연구에서는 물류 드론의 사생활 침해 문제를 해결하기 위하여, 입법, 거버넌스, 기술, 관리감독, 구제 등의 면에서 개선방안을 제시하였다. 이를 통해 저고도 경제의 질서 있는 발전을 보장하면서 시민 프라이버시 권리를 보호하는 견고한 방어선을 구축할 수 있다.

소개
전북대학교 동북아법연구소는 동북아법에 관한 국내외의 이론과 실제를 연구하고 교육하며, 그 결과를 발표하여 동북아법에 대한 이해의 증진과 동북아의 법률문화발전에 기여하기 위한 목적으로 2006년 7월 설립되었다.
서해안시대의 중심지역을 표방한 전라북도의 지리적 여건과 동북아시아의 여러 국가와의 인적 물적 교류가 확대되면서 그에 따른 여러 가지 법률문제가 발생됨에 따라 동북아시아의 지역적 특성을 고려한 법제도의 연구와 이들 국가와 거래하는 전북지역 자치단체와 기업에 대한 실질적 교육의 필요성이 대두되었다.
이러한 요청에 따라 법제도의 연구와 교육을 담당할 기관으로 전북지역 거점국립대학인 전북대학교가 동북아법연구소를 설립하게 되었고 전북 지방자치단체와 기업에 대한 교육과 자문프로그램을 운영하고 있다.
