This study critically examines the renewed social debate surrounding the lowering of the age threshold for juvenile offenders exempt from criminal punishment and analyzes the limitations of punishment-oriented approaches in responding to juvenile crime. In recent years, following several serious juvenile crime cases, social demands to lower the age of criminal responsibility have increased. However, such discussions tend to proceed without sufficient consideration of the structural causes of juvenile delinquency and the effectiveness of the current juvenile justice system. Accordingly, this study reconstructs the issue of lowering the age threshold for juvenile offenders not merely as a matter of criminal policy, but as a question of whether the current juvenile justice system effectively prevents recidivism. To this end, this study reviews the major arguments supporting the lowering of the age threshold and examines the limitations of deterrence- oriented punitive approaches. It further compares and analyzes the protective and rehabilitative welfare principles of the 소년법 and the operational realities of the current protective disposition system. In particular, this study suggests that insufficient continuous intervention after protective disposition, inadequate individualized educational and rehabilitative welfare systems, and limited support for social reintegration may function as factors that reinforce juvenile recidivism. Based on these discussions, this study proposes that the direction of juvenile crime policy should shift from punishment-centered approaches toward educational and rehabilitative welfare-oriented systems. Specifically, it suggests policy measures such as strengthening the practical educational functions of protective dispositions, establishing continuous case-management systems after judicial intervention, expanding early preventive intervention, and developing community-based integrated support systems. Ultimately, this study emphasizes that responses to juvenile crime should focus not on lowering the age of criminal responsibility, but on establishing practical educational and rehabilitative welfare systems that can prevent recidivism and support juveniles’ healthy reintegration into society.

이 연구는 최근 다시 사회적 쟁점으로 부상하고 있는 촉법소년 연령 하향 논의를비판적으로 검토하고, 소년범죄 대응에 있어 처벌 강화 중심 접근의 한계를 분석하는 데 목적이 있다. 최근 일부 소년 강력범죄 사건 이후 형사책임 연령을 낮추어야한다는 사회적 요구가 증가하고 있으나, 이러한 논의는 소년범죄의 구조적 원인과현행 사법체계의 실효성에 대한 충분한 검토 없이 이루어지는 경향이 있다. 이에 본연구는 촉법소년 연령 하향 문제를 단순한 형사정책의 문제가 아니라, 현재 소년 사법체계가 재범을 효과적으로 억제하고 있는가의 문제로 재구성하였다. 이를 위해 촉법소년 연령하향 논의의 주요 논리를 검토하고, 형벌의 억지력 강화중심 접근이 가지는 한계를 분석하였다. 이어 소년법의 보호·교정복지 이념과 현행보호처분 체계의 운영 현실을 비교·분석하였다. 특히 보호처분 이후 지속적 개입부족, 개별화된 교육·교정복지 체계의 미흡, 사회복귀 지원의 부족 등이 청소년 재범 구조를 강화하는 요인으로 작용하고 있음을 시사하였다. 이에 본 연구는 소년범죄 대응의 방향이 처벌 강화가 아니라 교육·교정복지 중심체계 구축으로 전환될 필요가 있음을 제안하였다. 구체적으로 보호처분의 실질적 교육 기능 강화, 보호처분 이후 지속적 사례관리 체계 구축, 조기 예방 중심 개입 확대, 지역사회 기반의 통합지원체계 마련 등을 정책적 과제로 제시하였다. 결국 소년범죄대응은 형사책임 연령 조정보다 재범 예방과 건전한 소년으로 사회복귀를 가능하게하는 실질적 교육과 교정복지 체계 구축을 중심으로 이루어져야 함을 강조하였다.
