This study points out the lack of specific compensation measures for the waiting time of workers receiving piece-rate pay under current law and seeks to explore directions for legal and institutional improvements. Article 50, Paragraph 3 of the current Labor Standards Act defines waiting time under the user's direction and supervision as labor time. However, due to the nature of the piece-rate system, where wage levels are determined in proportion to performance, there are no protective regulations for the “non-productive time” that inevitably occurs during the work process. Furthermore, while Article 5, Paragraph 2 of the Enforcement Decree of the Minimum Wage Act determines violations by dividing the total piece-rate wage by the total number of labor hours, this leads to a result where it is not considered a legal violation even if the employer does not provide separate compensation for the individual waiting time of piece-rate workers. As a direction for improvement, regulations should be established to compensate for the “non-productive time” of piece-rate workers, similar to the California Labor Code. Additionally, U.S. legislative cases can be referenced for the protection of waiting time for platform workers receiving piece-rate pay. New York City adopts a method of inducing platform companies to reduce waiting time and increase the number of effective dispatches by introducing a “Utilization Rate.” Meanwhile, Seattle directly compensates for waiting time by viewing it as a part of the work performance process through the “Associated Time Factor.” To resolve the blind spots of the current legal system, which only values the performance of those receiving piece-rate pay, this study aims to derive implications for compensation methods and legislative directions suited to the current situation, based on U.S. legislative examples that have introduced compensation systems for non-productive time.

본고는 현행법상 도급제 보수를 받는 자들의 대기시간에 대한 구체적인 보상 방안이 마련되어 있지 않은 문제를 지적하고, 이를 해결하기 위한 법 제도적 개선 방향을 모색하고자 한다. 현행 근로기준법 제50조 제3항은 사용자의 지휘・감독 아래 있는 대기시간을 근로시간으로 규정하고 있다. 하지만 성과에 비례해 임금 수준이 결정되는 도급제 특성상 업무 수행 과정에 대한 보호 규정은 없는 상황이다. 최저임금법 시행령 제5조 제2항은 도급제 임금 총액에 총 근로시간 수를 나누어 최저임금 위반 여부를 판단하고 있으나 이는 사용자가 도급제 근로자의 개별적인 대기시간에 대한 별도의 보상이 없더라도 법 위반이 아니라고 간주되는 결과를 초래한다. 이에 대한 개선 방향으로 캘리포니아주 노동법과 같이 도급제 근로자의 ‘비생산적인 시간’에 대해서도 보상하는 내용의 규정이 마련되어야 한다. 또한 도급제 보수를 받는 플랫폼 노무 제공자의 대기시간 보호를 위해 미국의 입법 사례를 참고할 수 있다. 뉴욕시는 ‘유효 이용률(Utilization rate)’을 도입하여 플랫폼 기업이 대기시간을 중이고 유효 배차 수를 늘리도록 유도하는 방식을 취한다. 시애틀은 ‘업무 시간 관련 요소’를 통해 대기시간을 업무 수행의 한 과정으로 보아 직접 보상하고 있다. 도급제 보수를 받는 자의 성과에만 가치를 부여하는 현행법 체계의 사각지대를 해소하기 위해 비생산적인 시간에 대한 보상 체계를 도입한 미국의 입법례를 바탕으로 현재 상황에 부합하는 보상 방식과 입법 방향에 관한 시사점을 도출하고자 한다.

본 학회는 1997. 4. 1 창립되어 노동법 분야를 주로 연구하는 단체이다. 본 단체는 국내법, 외국의 노동법 노사관계등의 인접학문분야, 국제노동법 등을 연구함으로써 현재 국내적으로 연구가 미진한 분야의 하나인 노동법 분야의 이론적 발전과 재정립. 진보적 이론 창안과 법해석을 통한 사회적 공헌을 그 목적으로 하고 있다.
학회 회의의 자격은 교수, 박사학위 소지자의 자격을 갖춘자를 정회원, 기타의 자를 준회원 또는 특별회원으로 한다. 본학회는 1998년 이후 '노동법 논총'이라는 학술지를 발간하고, 매년 봄(5월)과 가을(9월) 정기학회를 2회이상 개최한다. 학회의 회원은 전국적으로 교수, 공공단체, 연구기관, 공인노무사 및 변호사 등의 전문가로 구성되어 있다.
