In industrial accident compensation insurance, the presumption of occupational disease generally refers to the presumption of a causal relationship between work and the injury or illness. The current Industrial Accident Compensation Insurance Act, rather than explicitly presuming causation, employs the empirical rule of adequate causation as the standard for determining occupational disease. Consequently, the burden of proving causality directly falls on the injured worker, which often hinders the recognition of work-related accident or creates difficulties in reaching an compensation agreements with the employer. Although the Enforcement Decree of the Act does not explicitly state the “presumption of occupational disease”, it has introduced simplified procedures to expedite the recognition of industrial accidents by assessing “strong work-relatedness.” Given that the presumption of occupational disease originated in Germany, an in-depth understanding of the system under Germany’s Statutory Accident Insurance Act(SGB Ⅶ) is essential. From a comparative socio-legal perspective, German law offers meaningful implications for victim protection and procedural simplification. Notably, the principle of presumption of causation under German social law corresponds to a legal presumption inherent in prima facie evidence. To ensure effectively to rapidly changing industrial realities, it is necessary to distinguish between rebuttable and irrebutable presumptions. Furthermore, there is a need to systematize the legal doctrine that requires strict counter-evidence to ensure legal certainty. To resolve ambiguity regarding the presumption and proof of causality, legislation must clearly define and expand the scope of the presumption principle and applicable diseases. The application of this principles is expected to contribute to the theoretical systematization of shifting and mitigating the burden of proof, while establishing a fair, rapid, and simplified compensation system. Ultimately, clarifying the presumption of occupational disease and strengthening ex officio investigations will ensure the right of injured workers to participate in the process, developing the insurance system into a universal social safety net.

산재보험에서 업무상 질병의 추정은 일반적으로 업무와 재해 사이의 인과관계 추정을 의미한다. 현행 산재보험법은 인과관계를 추정하는 대신 경험칙상 상당한 인과관계가 존재하는지 여부를 업무상 질병 판단의 기준으로 한다. 이에 따라 현실적으로 상당인과관계를 재해근로자가 직접 증명해야 하는 부담은 업무상 재해의 불승인과 공상 합의 선택이라는 문제를 야기한다. 그러나 산재보험법 시행령은 ‘업무상 질병의 추정’을 명문화하지 않고, ‘업무관련성이 강하다’라는 평가로 대체하여 신속한 산재인정이 가능하도록 절차를 간소화하는 방식을 도입했을 따름이다. 입법적으로 업무상 질병의 추정은 독일에서 처음 도입했기에 독일의 법정재해보험법상 직업병 추정제도에 대한 심층적 이해가 필요하다. 비교사회법적 관점에서 국내적 업무상 질병 추정과 절차상 간소화를 통한 재해자 보호에 필요한 의미 있는 시사점을 도출할 수 있다. 특히, 독일 사회법상 인과관계 추정의 원칙이 일응의 추정효가 내재된 법률상 추정으로 보는 것과 급속히 변화하는 현실에 시의 적절하게 대응할 수 있도록 반증이 가능한 추정과 불가능한 추정으로 구분하고, 엄격한 반증 사실을 요구하는 경우와 사실상 반증, 즉 일정한 요건 아래 반증이 없는 한 추정하는 법리를 체계화 할 필요가 있다. 인과관계 추정 및 증명에 관한 법리적 불명확성을 해소하기 위해서는 입법을 통해 추정의 원칙 적용과 적용대상 질병의 범위를 명확히 규정하고 지속적으로 확대할 필요가 있다. 따라서 업무상 질병 인정절차상 추정의 원칙 적용은 인과관계 인정과 증명책임의 전환 및 완화 문제에 관한 이론적 체계화에 기여하는 동시에 신속하고 공정한 산재보상체계 구축과 간소화된 절차 운영도 가능하게 할 것으로 기대된다. 추가적으로 증명책임의 완화를 온전히 실현하기 위해서는 업무상 질병 추정의 원칙을 명시하고, 직권조사 원칙의 적용을 강화하여 재해근로자의 절차상 참여권을 보장하는 방식을 고려함으로써 보편적 사회안전망으로서의 산재보험제도 발전을 기대해 본다.

본 학회는 1997. 4. 1 창립되어 노동법 분야를 주로 연구하는 단체이다. 본 단체는 국내법, 외국의 노동법 노사관계등의 인접학문분야, 국제노동법 등을 연구함으로써 현재 국내적으로 연구가 미진한 분야의 하나인 노동법 분야의 이론적 발전과 재정립. 진보적 이론 창안과 법해석을 통한 사회적 공헌을 그 목적으로 하고 있다.
학회 회의의 자격은 교수, 박사학위 소지자의 자격을 갖춘자를 정회원, 기타의 자를 준회원 또는 특별회원으로 한다. 본학회는 1998년 이후 '노동법 논총'이라는 학술지를 발간하고, 매년 봄(5월)과 가을(9월) 정기학회를 2회이상 개최한다. 학회의 회원은 전국적으로 교수, 공공단체, 연구기관, 공인노무사 및 변호사 등의 전문가로 구성되어 있다.
