인공지능(AI) 도입에 따른 112 치안종합상황실 조직개편 및 법적 책임 체계 연구
A Study on Organizational Restructuring and Legal Accountability for the Implementation of AI-based 112 Emergency Response Systems
This study examines organizational restructuring and legal accountability frameworks required for integrating artificial intelligence (AI) into 112 Emergency Dispatch Centers.
Because 112 emergency services are high-risk public services directly linked to citizens' lives, bodily safety, and fundamental rights, AI adoption cannot be assessed only by technical efficiency. The central contribution of this study is to integrate organizational restructuring, legal authority, liability attribution, and limited immunity into a single risk-based Human-in-the-loop (HITL) accountability model.
The study employs legal analysis, literature review, comparative case analysis, and scenario-based organizational design. The findings suggest that full automation should be limited to simple and repetitive Code 4 tasks. Codes 2 and 3 require an “AI recommendation + human approval” model, while Codes 0 and 1 require an “AI assistance + human final decision” model. The essence of organizational restructuring is not workforce reduction but role transition: dispatch operators become HITL decision-makers, analysts become AI quality monitors, and management teams become algorithmic governance units.
The study further argues that explicit legal authorization is necessary for AI-assisted access to reporting histories, location information requests, voice-data training, logging, explanation, and post-hoc audit mechanisms. Liability should be attributed not to AI itself but to the human actors and state institutions that design, procure, operate, and supervise the system. Victims should be compensated primarily by the state, while internal indemnification should be allocated among suppliers, managers, and operators according to fault. Limited reliance immunity should be recognized for officers who use certified systems, complete required training, comply with HITL manuals, respond to warning signs, and preserve logs. In conclusion, AI adoption in 112 dispatch centers should be understood as the redesign of high-stakes public decision-making rather than a labor-saving project.

본 연구는 112 치안종합상황실에 인공지능(AI)을 도입할 때 필요한 조직개편 방향과 법적 책임 체계를통합적으로 검토한다. 112 업무는 국민의 생명ㆍ신체와 직접 연결되는 고위험 공공서비스이기에, AI의효율성만을 기준으로 자동화 범위를 정하는 방식은 충분하지 않다. 본 연구의 핵심 기여는 조직개편, 법적권한 부여, 책임 귀속, 면책 체계를 각각 별개의 쟁점으로 나열하는 데 있지 않고, 이 네 요소를 하나의위험기반 Human-in-the-loop(HITL) 책임배분 모형으로 연결하는 데 있다.
이를 위해 문헌연구, 현행 법령 분석, 국내외 사례 비교, 코드별 시나리오 기반 조직설계를 수행하였다.
특히 선행연구가 112 상황실 AI의 기술적 가능성, 경찰 언어모델 개발, 공공부문 AI 도입의 일반 원칙을주로 논의해 온 것과 달리, 본 연구는 112 신고 대응 코드의 법적 성격과 인간 감독의 강도를 결합하여자동화 수준을 차등화하고, 그에 상응하는 조직ㆍ권한ㆍ책임 구조를 제안한다.
연구 결과, AI 도입 전면자동화는 코드 4 중에서도 단순 반복형 상담ㆍ민원ㆍ안내 업무에 한정되어야하며, 코드 2ㆍ3은 현장 출동 또는 현장 확인과 연결될 수 있으므로 “AI 추천 + 인간 승인” 구조가 타당하며, 코드 0ㆍ1은 “AI 보조 + 인간 최종 결정” 구조를 유지해야 한다. 조직개편의 핵심은 인력 감축이 아니라역할 전환을 중심으로 이루어져야 하며, 지령 요원은 AI 추천을 승인하는 최종판단자, 분석 요원은 AI 품질관리와 이상 징후 감시자, 관리팀은 조달ㆍ보안ㆍ업데이트ㆍ감사를 총괄하는 거버넌스 조직으로 재정의되어야 한다. 셋째, 법적 쟁점에서는 위치정보 제공요청, 신고 이력 조회, 음성데이터 재학습, 자동화된 결정에 대한 설명ㆍ기록ㆍ사후통제에 관한 명시적 수권 규정과 샌드박스형 특례가 필요하다. 넷째, 책임체계는 AI 자체가 아니라 AI를 설계ㆍ도입ㆍ운영ㆍ감독한 인간과 국가에 귀속되어야 하며, 피해자에 대해서는 국가가 우선 배상한 후 공급자ㆍ관리자ㆍ운영자 사이의 귀책 정도에 따라 구상하는 구조가 타당하다.
다만 담당 경찰관이 인증된 시스템을 사용하고, 교육을 이수하며, 매뉴얼상 인간 개입 의무와 로그 보존의무를 이행한 경우에는 제한적 신뢰 면책을 인정할 필요가 있다.
결론적으로 112 상황실의 AI 도입의 본질은 인력 절감이 아닌 고위험 공공의사결정의 재설계에 있다.
AI는 접수의 정확도와 속도를 높일 수 있지만, 생명ㆍ신체ㆍ기본권에 실질적 영향을 미치는 최종 판단은인간이 책임 있게 통제해야 한다. 이 연구는 그 전제 아래 112 법제, 조직, 감사, 책임 구조를 함께 정비하는입법ㆍ정책 방향을 제안한다.
