The Republic of Korea’s criminal justice landscape is on the precipice of a fundamental structural transformation. The amendment of the Government Organization Act (Law No. 21065), scheduled for enforcement on October 2, 2026, marks a historic departure from the traditional prosecutorial-led model toward a decentralized system characterized by the establishment of the “Prosecution Office” and the “Major Crime Investigation Office.” This strategic reorganization aims to institutionalize the decoupling of investigation from prosecution, effectively positioning the police as the primary and autonomous subject of criminal investigations. However, this legislative evolution has concurrently exposed a critical and anachronistic “legislative lacuna”: the absence of “Judicial Police Officer” status for high-ranking police officials?specifically those at the rank of Senior Superintendent General (Chi-an-gam), Chief Superintendent General (Chi-an-jeong-gam), and the Commissioner General (Chi-an-chong-gam). This research identifies a profound mismatch between administrative authority and procedural responsibility. Under Article 197 of the current Criminal Procedure Act, the legal scope of a Judicial Police Officer is capped at the rank of Superintendent General (Kyeong-mu-gwan). This limitation is a stagnant vestige of the 1954 legal hierarchy that has failed to adapt to the expansion of the police rank structure in 1969 and the subsequent empowerment of the National Investigation Bureau. Consequently, the highest-ranking commanders who exercise substantive strategic oversight over national investigations lack the formal legal standing required by procedural law. This discrepancy undermines “procedural legitimacy” and the constitutional principle of due process, as the ultimate decision-makers in the investigative hierarchy are technically excluded from the very legal category that grants the power to initiate and direct investigations. Through a comparative legal analysis, this study examines Japan’s “Judicial Police Official” system. Unlike the rigid, rank-capped Korean model, Japan utilizes a flexible designation framework rooted in the “Emergency Measures Act for the Designation of Judicial Police Officials” (Law No. 234, 1948) and the “Rules on the Designation of Judicial Police Officials” (National Public Safety Commission Rule No. 5, 1954). In the Japanese system, the Commissioner General of the National Police Agency is explicitly designated as a “Judicial Police Officer”, ensuring that command authority is perfectly aligned with procedural status. By viewing the “Judicial Police” as a “Functional Group” rather than a mere administrative byproduct of rank, Japan maintains a seamless chain of legal accountability. In light of these findings, this study proposes three legislative strategies to secure the legitimacy of the 2026 investigative era: (1) A direct amendment of Article 197 of the Criminal Procedure Act to explicitly include all ranks above Superintendent General; (2) The establishment of specific investigative rules within the “Criminal Procedure Act” to bridge the gap in supervisory authority; and (3) The fundamental transfer of the definition of Judicial Police Officers from procedural law to organizational law (the Police Personnel Act). This third alternative is presented as the most robust solution, ensuring that future organizational shifts do not create new legal voids. Ultimately, this study argues that reconciling the legal status of high-ranking officials with their actual command authority is not merely a technicality but a mandatory requirement for the integrity and public trust of the Korean criminal justice system.

본 연구는 2026년 10월 2일 시행 예정인 정부조직법 개정(법률 제21065호)에 따른 수사ㆍ기소 분리국면에서, 대한민국 경찰 수사 체계의 법적 정당성과 책임성을 강화하기 위한 입법적 대안을 모색하는데 목적이 있다. 최근 검경 수사권 조정과 조직 개편을 통해 경찰은 수사의 주체로서 독자적인 수사 개시권과 종결권을 부여받았으며, 이는 경찰 수사 지휘부의 법적 지위에 대한 명확한 재정의를 강력히 요구하고있다. 현행 형사소송법 제197조는 사법경찰관의 범위를 ‘경무관’ 이하의 계급으로 한정하고 있다. 이는 1954 년 형사소송법 제정 당시의 경찰 계급 구조를 답습한 결과로, 이후 경찰공무원법 제정을 통해 신설된치안감, 치안정감, 치안총감 등 고위직 계급은 법적인 사법경찰관 지위에서 배제되어 있는 실정이다. 이러한입법적 불비는 실질적인 수사 지휘의 정당성 문제를 야기한다. 특히 2014년 인천지검이 인천지방경찰청장(치안감)에게 발송한 수사지휘서와 관련하여, 치안감이 사법경찰관이 아니라는 이유로 수사지휘의 직접적대상이 될 수 없다고 판단된 사례는 현행법의 실체적 위험성을 단적으로 보여준다. 국가수사본부장 등실질적인 최종 수사 지휘권자가 사법경찰관으로서의 법적 지위를 갖지 못한 채 ‘권한과 책임의 불일치’ 상태에 놓여 있는 것은 적법절차의 원리를 훼손할 뿐만 아니라, 수사 행정의 논리적 붕괴를 초래한다. 본 연구는 이러한 법적 공백을 해결하기 위해 우리와 유사한 법체계를 공유하는 일본의 ‘사법경찰직원’ 제도를 비교법적으로 분석하였다. 일본은 1948년 제정된 ‘사법경찰직원 지정에 관한 법률(법률 제234호)’ 등을 통해 최고위직인 경찰청 장관부터 순사부장까지를 ‘사법경찰원’으로 지정하고 있다. 특히 일본은사법경찰직원의 범위를 국가공안위원회 및 도도부현 공안위원회 규칙에 위임함으로써, 계급에 국한되지않고 실질적인 수사 직무 수행 가능 여부에 따라 수사 주체성을 부여하는 유연성을 확보하고 있다. 연구의 결론으로 본 연구는 세 가지 입법적 개선 방향을 제시한다. 첫째, 형사소송법 제197조를 개정하여치안감 이상의 계급을 사법경찰관 범위에 명시적으로 포함하는 방안이다. 둘째, 형사소송법에 고위직의수사 지휘 및 감독 권한을 별도 조항으로 신설하는 방안이다. 셋째, 사법경찰관리의 정의를 형사소송법이아닌 ‘경찰공무원법’에 규정하여 계급 변동에 따른 입법 불비를 원천적으로 예방하고 절차법과 조직법의연동성을 확보하는 방안이다. 이러한 법제 개선은 수사 주체로서 경찰의 법적 근거를 확립하고, 향후 중대범죄수사청 신설 등 급변하는 형사사법 환경에서 경찰 수사의 책임성을 담보하는 핵심 기제가 될 것이다
