This article examines the concept of “prostitution” within the contemporary Japanese legal framework and explores the complexities of sexual discourse that judicial language fails to capture, focusing on the case of “Riri” (リリ, 渡辺真衣). By analyzing the so-called Riri case from linguistic, historical, and agent-centered perspectives, this study argues that the court’s fraud conviction focused predominantly on the technical elements of the crime, thereby failing to address the underlying gendered power relations and contradictory human perceptions. First, from a linguistic perspective, the article highlights how terms denoting sexual acts and relationships have shifted toward expressions characterized by translatability and value neutrality, and considers how these shifts complicate existing notions of “prostitution.” Second, from a historical perspective, the Riri case is reexamined within the broader trajectory of postwar Japanese sexual culture, drawing on Yamashita’s historical account of “Gaishō”(街娼). Finally, from the perspective of the acting subject, the study analyzes Riri’s prison memoirs and interviews to illuminate forms of subjectivity that transcend conventional definitions of “prostitution” or the narrow framework of legal disputes.

본고는 현재 일본법에서 사용되는 ‘매춘’ 개념과 사법적 언어가 포착하지 못한 성적 담론의 복잡성에 관해 고찰하는 목적에서 ‘리리’라는 여성에 주목한다. 2023년에 일본에서 있었던 리리 사건을 언어적 관점, 역사적 관점, 행위 주체의 관점에서 분석함으로써 리리에게 내려진 ‘사기’ 판결이 기술적 범죄 사실에만 집중했을 뿐 사건 이면에 얽힌 성별 권력과 인간의 모순적 인식을 충분히 규명하지 못했다는 점을 지적한다. 먼저 언어적 관점에서는 성적 관계 및 행위를 나타내는 언어들이 번역불가능하고 가치중립적인 말들로 변천해가는 현상에 주목하여 기존의 ‘매춘’ 개념의복잡화에 관해 생각해보고자 했다. 다음으로 역사적 관점에서는 전후일본의 성풍속에 관한 야마시타의 정리를 토대로 “가창”의 역사 속에 리리 사건을 재조명하였다. 마지막으로 행위 주체의 관점에서는 ｢리리의 옥중수기｣와 당사자 인터뷰를 이용하여 기존의 ‘매춘’ 개념이나 법적 공방으로는포착할 수 없는 주체성에 주목했다. 리리는 가해자 및 피해자 의식에서 완전히 벗어나, ‘약한 여자아이’ 서사를 연기하면서도 동시에 호스트에 대해서는 ‘보살핌’이라는 여성성을 보여주고 중년남성에 대해서는 물상화(“인간 대 인간으로 마주했다는 감각이 아니라서요”)적 사고를 보여준다. 행위 주체적 관점에서는 사회적으로 요구된 여성성을 남성 혐오에 재이용한 사례라 할 수 있다.

本稿は、現行日本法において用いられている「売春」概念と、司法的言語が捉えきれない性的言説の複雑さについて再考することを目的に「リリ」という女性に注目する。2023年に日本で発生した事件を、言語的観点・歴史的観点・行為主体の観点から分析することにより、リリに下された「詐欺」という判決が、技術的な犯罪事実の認定にのみ焦点を当てるものに終わり、事件の背後に絡み合うジェンダー権力および人間の矛盾した認識を十分に解明し得なかった点を指摘する。まず、言語的観点からは、性的関係および行為を表す言語が、翻訳不可能性を帯びつつ、価値中立的な語へと変容していく現象に着目し、既存の「売春」概念が捉えきれなかった複雑な現象が言語として表出されていく現象として捉える。次に、歴史的観点からは、戦後日本の性風俗に関する山下の整理を踏まえ、「街娼」の歴史の中にリリ事件を照らし合わせてみる。最後に、行為主体の観点からは、「リリの獄中手記」および当事者インタビューを用い、従来の「売買春」概念や法的枠組みでは捉えきれない主体性に注目する。
