This study aimed to explore the historical background of the introduction of the constitutional amendment on the political neutrality of education, based on the transcripts of the constitutional review public hearings conducted during the period of the Fifth Constitutional Amendment. Despite the significant impact of the political neutrality of education on education, discussion on its background of introduction has been insufficient. It appears to stem from the lack of relevant meeting records at the time. Accordingly, this study examined the background of the amendment’s introduction by analyzing the stenographic records of the constitutional review public hearings held immediately prior to the determination of the clause through thematic analysis. The findings indicate that the political neutrality of education emerged from a historical context in which external interventions — such as administrative involvement and policy fluctuations — hindered the realization of proper education despite the recognized importance of education. Based on this historical background, a review of Constitutional Court decisions revealed that the Court’s interpretation frames the political neutrality of education as an obligation that restricts teachers’ rights, showing aspects that differ from its historical context. Therefore this study reaffirms the original intent of preventing undue intervention in education and suggests the need to reconsider interpretations of teachers’ political neutrality.

본 연구는 교육의 정치적 중립성 조항 도입의 역사적 배경을 제5차 헌법개정 시기 진행된 헌법 심의 공청회 자료를 바탕으로 탐색하고자 했다. 교육의 정치적 중립성 조항은 교육 현장에 미치는 영향에도 불구하고 그 도입 배경에 대해 논의가 충분치 않았다. 이는 당시 관련 회의록 등이 충분 치 않은 상황에 기인하고 있다. 이에 본 연구에서는 해당 조항의 확정 직전에 진행된 헌법심의 공 청회의 속기록 자료를 주제분석 방식으로 분석하여 도입의 배경을 살폈다. 그 결과 교육의 정치적 중립성은 교육의 중요성에도 행정적인 개입이나 정책의 변동 등 외부의 개입이 제대로 된 교육을 실현하기 어렵게 해 온 시대적 배경에서 제기된 것으로 나타났다. 이와 같은 역사적 배경을 바탕으 로 헌법재판소의 판례를 검토한 결과, 교육의 정치적 중립성이 교원의 권리를 제한하는 하나의 의 무로 작용한다는 측면에서 헌법재판소의 해석이 역사적 배경과 상이한 측면이 확인되었다. 이에 교육에 대한 부당한 개입 방지라는 도입 취지를 재확인하고, 교원의 정치적 중립성 해석에 대한 재검토의 필요성을 제시했다.
