Most commercial AI require a significant amount of text, images, and videos during machine learning, but most of works are protected by copyright. Using such works without obtaining authors’ permission and paying royalties may infringe copyright. However, to promote the development of new technology, ‘human-unreadable’ AI ‘use of work as data’ should fall outside the scope of copyright protection. Fair use is a useful defense, but some commercial AI do not cause an impact on market profit of works and pass ‘three step test’, they could be exempted by fair use. For most commercial AI, applying a compulsory license is better for keeping sufficient sources, balancing interests and promoting diversity of art creation. Dealing with copyright issue in commercial AIs requires collaborative governance, it is recommended to establish a model of opt-out and a collectively managed tiered pricing, establish an ecosystem for group licence, and commercial AI companies should cooperate with copyright protection.

상업적 인공지능은 기계학습과정에서 대량의 텍스트, 이미지, 영상자료를 필요로 하며, 이러한 자료의 대부분은 저작권의 보호를 받고 있다. 저작자의 허락이나 사용 료 지급 없이 저작물을 이용하는 경우 저작권 침해 문제가 발생할 수 있다. 그러나 신기술 발전을 촉진하기 위해 인간이 직접 인식하거나 열람할 수 없는 형태의 데이 터로서 이루어지는 인공지능의 저작물 이용은 일정한 범위에서 저작권 보호의 대상 에서 제외될 필요가 있다. 공정이용은 이러한 문제에 대한 중요한 해결 수단이 될 수 있으며, 일부 상업적 인공지능의 이용이 저작물의 시장가치에 실질적인 영향을 미치 지 않고 3단계 심사기준을 충족하는 경우 공정이용의 적용 가능성이 있다. 한편, 대 부분의 상업적 인공지능에 대해서는 데이터 이용의 안정적인 공급을 확보하고 이해 관계자의 이익을 조정하기 위해 강제 허락 제도의 도입이 보다 적절하다. 또한 상업 적 인공지능 시대의 저작권 문제 해결을 위해 협력적 거버넌스가 필요하며, 옵트아웃 방식과 집단 관리 기반의 단계적 요금체계 도입 및 집단적 이용 허락 생태계 구축이 요구된다.
