This study aims to propose an effective guideline for non-competition agreements, which are essential for preventing insider technology leakage amid serious issues concerning core national technologies and trade secrets. Currently, the non-competition agreements in South Korea suffer from ambiguous legal standards and inconsistencies among institutional guidelines, leading to frequent disputes. Accordingly, this study comprehensively analyzes the Supreme Court’s criteria, major domestic case laws and systems regarding noncompetition agreements, as well as standardized forms and guidelines issued by government agencies. Based on this analysis, it proposes practical guidelines for non-competition agreements focusing on key elements such as a clear definition of protectable employer interests, customized agreements tailored to employees’ positions and job characteristics, reasonable restrictions on duration, geographic scope, and job type, appropriate compensation, and consideration of public interest and circumstances of resignation. Furthermore, the study emphasizes the importance of differentiated conditions according to employee rank, detailed contract formulation, and education and awareness promotion for stakeholders to enhance predictability and prevent disputes in practical application. The proposed guidelines aim to balance the dual objectives of preventing technology leakage and respecting employees’ freedom in career choice, ultimately contributing to the establishment of a robust non-competition agreement system that provides a significant foundation for strengthening domestic industrial competitiveness and improving working conditions.

국가핵심기술, 영업비밀 등 내부자에 의한 기술유출이 심각한 상황이다. 이에 본 연구는 기술 유출 방지에 필수적인 경업금지약정에 대한 실효적 가이드라인을 제안하는 데 목적이 있다. 현 재 우리나라의 경업금지약정과 관련한 분쟁이 발생하고 있지만 법적 기준이 모호하고 지원 기관 별 지침도 상이한 상황이다. 본고에서는 경업금지약정의 유효성에 대한 대법원의 판단 기준 등 관련 판례, 관련 지원제도, 지원 기관별 서식 및 가이드라인을 종합적으로 분석하였다. 경업금지 약정의 실효성을 담보하기 위해서는 보호할 가치가 있는 사용자 이익의 명확화, 근로자의 직 위·업무 특성에 맞춘 맞춤형 약정, 합리적인 제한 기간·지역·직종 설정, 적절한 대가, 공공 이익과 퇴직 경위 고려 등이 필요하다는 점을 제시하였다. 또한, 계약실무 적용의 예측 가능성과 분쟁 예방을 위해 직위별 차등화된 경업금지 조건 설정과 약정의 구체화, 관계자 교육 및 가이드 라인 홍보도 아울러 필요하다. 경업금지약정 가이드라인은 기술유출 방지와 근로자의 직업 선택 자유 존중이라는 두 가지 목표를 균형 있게 달성할 수 있으며, 궁극적으로는 기술유출 방지를 통 한 산업경쟁력 강화와 근로환경 개선에 중요한 기반이 될 것이다.
