Since the Westphalian system was established in 1648, international law and multilateralism have developed in close connection. International law seeks to address the challenges facing the international community, and state cooperation is essential to that goal. The power created through cooperation should prevent violations of international law and advance the common good of all states. In this sense, multilateralism plays a crucial role in maintaining international order and ensuring that international law functions effectively. Today, multilateralism faces a serious crisis that weakens the effectiveness of international law. The spread of Superpowers’ unilateralism, new geopolitical rivalries, and the rise of populism and sovereignism have left multilateralism paralyzed, while international organizations are no longer functioning as effectively as intended. Yet, focusing solely on these phenomena provides an incomplete understanding of what the current crisis of multilateralism means for international law. Does the crisis of multilateralism amount to a crisis of international law itself? What opportunities, if any, might this decline present for the development of international law? Should international law reconsider and transform its traditional attitude toward multilateralism? Within the realities of power politics, does international law possess the structural capacity to reinvigorate and sustain multilateralism? And finally, what alternative frameworks might be envisioned to replace or supplement the existing multilateral order? These questions call for a thorough legal examination of the relationship between international law and multilateralism. Exploring the implications of the current crisis may offer a deeper understanding of the normative resilience and adaptability of international law in a shifting global landscape.

1648년 웨스트팔리아체제 수립 이후, 국제법과 다자주의는 밀접한 관련을 맺어 왔다. 국제 법은 국제사회가 직면한 문제를 해결해야 하며, 문제 해결에 있어서 국가의 협력은 필수적이 다. 국가의 협력을 통해 형성된 힘은 개별 국가의 국제법 위반을 억제하고 국제사회 전체의 이익을 위해 활용되어야 한다. 이러한 맥락에서 다자주의는 국제사회의 질서 유지는 물론이 며 국제법 운용에 있어서 중요한 역할을 담당한다. 그러나, 오늘날 다자주의는 위기에 봉착하고 있으며, 다자주의의 위기는 국제법의 실효성 에 심각한 영향을 미치고 있다. 강대국 일방주의의 확산, 지정학에 근거한 새로운 세력균형 등장, 대중영합주의와 주권주의의 대두에 따라 다자주의는 마비 상태에 이르고 있으며, 국제 기구 또한 제대로 작동되고 있지 않다. 그러나, 다자주의의 위기를 강대국 일방주의의 확산, 국제기구의 무기력함과 같은 현상에 집중하여 접근하는 것은 다자주의의 위기가 국제법에 던지는 화두를 검토하는 데 적절하지 않다. 다자주의의 위기가 곧 국제법의 위기인가? 다자주의의 위기는 국제법에 어떠한 기회를 제 공하는가? 다자주의에 대한 국제법의 태도는 전환될 필요가 있는가? 권력 정치의 현실에서 국제법은 다자주의를 활성화할 수 있는 구조를 갖추고 있는가? 다자주의에 대한 대안은 어떤 것이 제안될 수 있는가? 이와 같은 문제에 대한 국제법적 검토가 필요하다. 다자주의의 위기가 국제법에 어떠한 함의를 갖는가를 검토함으로써 국제법의 실효성을 이해할 수 있을 것이다.
