The Local Autonomy and the Role of the Senate in France

The 348 French Senators are elected through indirect universal suffrage for six years. This means that they are chosen by an electoral college in each département, which is composed of ‘members of the National Assembly for the département and members of the département's General Council as well as the more extensively sited Regional Council’ and ‘delegates from municipal councils who in fact account for 95 per cent of the members of the electoral colleges’. Article 24, paragraph 4, sentence 2 of the French Constitution prescribes that “The Senate shall ensure the representation of the territorial communities of the Republic”. Any reflection on Article 24, paragraph 3, necessarily leads to a connection or an attempted connection between territorial decentralization, which is one of the characteristics of french administrative organization, and the composition of the National Assembly. Since the early 1980s, a number of authors have established a direct link between the increased autonomy enjoyed by local authorities following decentralization laws and their representation in the second chamber. Some scholars have conceptualized this representation as an integral component of the constitutional status of local authorities. This is evidenced by the fact that, in accordance with Article 72 of the Constitution, which guarantees them freedom of administration, Article 24 ensures their representation in the Senate. The Senate today would appear to be tempted by a different reading of Paragraph 4 of Article 24 of the Constitution that goes beyond the way in which it is elected. It sees itself as representative of local and regional authorities, the Upper House's role being to defend their interests at a national level. Proposals have already been made to increase the powers of the Senate in the discussion of proposed laws concerning local administration.

프랑스는 1789년 시민혁명을 거치면서 강력한 중앙집권국가를 유지하여 오다가, 1982년에 본격적으로 지방분권이 실시되어 지방의 정치행정 체제에 커다란 변화를 가져왔으며, 2003년에 헌법개정을 통하여 지방분 권을 강화하였다. 프랑스 헌법은 제1조 제1항에서 ‘프랑스 조직은 지방분권이다’라고 규 정하고 있을 만큼 지방분권을 강조하고 있다. 이는 그만큼 지방분권을 헌법적인 차원에서 집행하겠다는 의지를 나타내는 것이라 할 수 있다. 지방자치에서 상원은 매우 중요한 역할을 한다고 할 수 있다. 헌법 제 24조 제4항은 상원은 지방자치단체를 대표한다고 하여 대표성을 인정하 고 있다. 이를 위하여 상원의원은 지방의회 의원 등이 선거인단이 되어 당선되는 간접선거제를 채택하고 있다. 또한 헌법 제39조에서는 지방자 치단체의 주요 조직에 관한 정부발의 법률안은 상원에 제출하도록 하고 있다. 즉 상원은 국민의회와 함께 입법권을 행사하며, 특히 지방자치 제 도 및 조직에 관한 법률 제정 시 지방 정부의 이익이 침해되지 않도록 보호하는 역할을 한다. 상원은 지방자치단체의 ‘자유로운 행정’ 원칙이 헌법적으로 보장되고 실질적으로 구현되도록 감시하고 지원하는 역할을 수행한다. 상원은 지 방의회 의원 등으로 구성된 선거인단에 의하여 선출되기 때문에 지방자 치단체의 이익을 위한 입법을 하게 되는 것이다. 또한 많은 상원 의원들 이 지방 행정을 직접 담당했던 경험이 있거나, 여전히 지역 사회와 긴밀 한 관계를 유지하고 있어 지방 현실을 잘 이해하고 있다고 할 수 있다. 결국 프랑스 상원은 중앙 정부의 일방적인 정책 추진을 견제하고, 법 률 제정 과정에서 지방자치단체의 특수한 상황과 요구사항을 반영하는 지역 대표형 의회로서의 독특한 지위를 가진다고 할 수 있다.
