The recent seriousness of climate change has led to discussions on responding at the constitutional level beyond the legislative level. In particular, a series of discussions on constitutional amendments due to climate change, such as the 2023 Constitutional Amendment Advisory Committee's constitutional amendment bill after the Asian Minimum Climate Litigation, is submitted to a constitutional amendment according to climate change, and it is judged that climate change is recognized as a factor of social change at the constitutional level and changes in the value of constitutional norms are required accordingly. Issues on constitutional amendments related to climate change include measures to stipulate climate change in the constitution beyond the level of amendments to the existing environmental rights and environmental preservation obligations, or to specify a wide range of concepts such as protection of future generations and sustainable development in the constitutional code. According to the results of expert opinion analysis, most of the respondents not only agree on the need for a constitutional response to climate change, but also believe that a plan to stipulate new concepts related to climate change is necessary. However, given that climate change, protection of future generations, and sustainable development are unclear in concept, it is expected that the accumulation of empirical basic data related to constitutional amendment by adding literature analysis and questionnaire analysis will continue in that more sufficient discussion on constitutional amendment should be supported, and more sufficient opinion collection is needed.

최근 더해지는 기후변화의 심각성은 입법적 차원을 넘어 헌법적 차원 의 대응을 논의하게 만들고 있다. 특히, 아시아 최소 기후소송 이후 2023년 헌법개정자문위원회 개헌안에 기후변화에 따른 헌법개정안에 제 출되는 등 일련의 기후변화에 따른 헌법개정논의는 기후변화를 헌법적 차원의 사회변화 요인으로 인식하고 그에 따른 헌법규범의 가치변화가 요청되는 상황이라 판단된다. 기후변화와 관련된 헌법개정 쟁점은 기존 의 환경권 및 환경보전의무조항의 개정 수준을 넘어, 기후변화를 헌법상 명문화 하거나, 미래세대 보호 및 지속가능발전과 같은 광범위한 개념을 헌법전에 명시하는 방안도 포함한다. 전문가설문분석 결과에 따르면, 대 부분의 응답자들은 기후변화로 인한 헌법적 대응의 필요성을 공감하고 있을 뿐만 아니라, 새로운 기후변화 관련 개념들을 명문화 하는 방안이 필요하다고 보기도 한다. 다만, 기후변화 및 미래세대 보호, 지속가능한 발전 등은 개념상 불명확성을 갖는다는 점에서 보다 충분한 개헌논의가 뒷받침 되어야 할 뿐만 아니라, 보다 충분한 의견수렴이 필요할 것이다. 이에 본 연구는 기후변화에 따른 헌법개정 쟁점을 고찰하고, 각 쟁점별로 간단한 전문가 설문조사를 실시하여 그 결과를 분석함으로써, 향후 개헌논의시 기후변화와 관련된 개헌의제에 있어 보다 실증적인 기초자료를 제시하고자 한다.
