As of 2024, there are 10,733 fishers employed on fishing vessels in Korea (1,089 in distant‑water fisheries; 9,644 in coastal and inshore fisheries). This accounts for about 40% of all seafarer employment(27,169), including merchant marine crew, representing a significant share. Meanwhile, the fishing operations environment on fishing vessels, much like in other industrial workplaces, inherently involves constant risks related to dangerous machinery and equipment. The introduction of new fishing methods further increases hazards in terms of industrial accidents. Thus, in matters of safety and health, the fishing industry is always exposed to potential risk factors. In addition, considering the characteristics of each fishing vessel according to its various fishing methods, in order to maintain and promote the safety and health of the fishers, it is necessary to comprehensively consider the potential characteristics of fishers to be injured or cause harm (damage) to their health due to fishing or other work, and the possibility and seriousness of danger and harm that can lead to injury or disease. However, the government’s support policies related to fishers are mainly limited to introducing policy insurance systems to compensate for accidents among fishers, or establishing institutional measures for safe fishing operations of fishing vessels, and thus face the social problem of limitations as a practical response. In this regard, the government has recently established and is currently operating the “Act on Safe Fishing Operations of Fishing Vessels and Promotion of Safety and Health of Fishers” as part of measures to cope with the need for a management and supervision system to handling the working environment of fishing vessels more efficiently. On the other hand, such legislative measures were revised the previous “Act on Safe Fishing Operations of Fishing Vessels” to unify the safety and health of fishers to the “Ministry of Oceans and Fisheries”, and some of the contents of the “Occupational Safety and Health Act” are applied, but this is only a fragmentary supplement to the transfer of government management to fishers. In particular, the “Act on Safe Fishing Operations of Fishing Vessels and Promotion of Safety and Health of Fishers” shall include all fishing vessels owned by the Korean people and the government in the scope of its application, but some fishing vessels have exceptions and do not consider safety voids for fishers. Accordingly, this paper examines the overall structure and details of the current safety and health laws and regulations for fishers. And based on this, propose improvement measures to ensure more stable and effective application in the field through legislative overhaul focusing on matters that require additional review to maintain and promote the safety and health of fishers.

우리나라 수산업에 종사하는 근로자 중 어선에서 근로를 제공하기 위하여 고용된 어선원은 2024년 기준 총 10,733명(원양 1,089명, 연·근해 9,644명)으로 이는 상선을 포함한 전체 선원취업 현황(27,169명) 대비 약 40% 정도로 상당한 비중을 차지하고 있다. 한편, 어선에서의 조업(操業) 환경은 다른 산업계의 작업장과 유사하게 위험한 기계·기구의 사용과 함께 새로운 공법의 도입 등에 따른 산업재해상의 위험요소(안 전·보건 분야)를 항상 내포하는 특징을 보인다. 또한 어선의 다양한어로 방식에 따 른 각각의 특성을 감안하면 어선원의 안전·보건을 유지·증진하기 위해서는 어선원이 어로 작업 또는 그 밖의 업무로 인하여 상해를 입거나 건강에 유해(손해)를 끼칠 수 있는 잠재적 특성과 위험·유해가 부상 또는 질병으로 이어질 수 있는 가능성과 중대 성 등을 종합적으로 고려하는 것이 필요하다. 그러나 어선원과 관련한 정부 지원 정책은 주로 어선원의 재해발생시 이를 보상 하기 위한 정책보험제도 도입이나, 어선의 안전조업과 관련한 제도적 장치를 두는 정도에 그치고 있어 실질적인 대응책으로서의 한계가 있다는 사회적 문제에 직면하 고 있다. 이와 관련해서 최근 정부에서는 어선의 작업환경에 있어 보다 효율적으로 대처하기 위한 관리·감독 체계의 필요성에 따른 조치의 일환으로 ｢어선안전조업 및 어선원의 안전·보건 증진 등에 관한 법률｣을 마련하여 현재 운영 중이다. 반면, 이 같은 입법조치는 어선원의 안전·보건에 대한 사항을 해양수산부로 일원 화하면서 종전 ｢어선안전조업법｣을 개정한 것으로 이는 ｢산업안전보건법｣ 일부 내용을 준용한 정도에 지나지 않으며 단지 어선원에 대한 정부 관리 주체 이관에 따른 단편적 보완책에 불과하다. 특히 ｢어선안전조업 및 어선원의 안전·보건 증진 등에 관 한 법률｣은 그 적용범위에 있어 대한민국 국민·정부가 소유하는 모든 어선을 포함하 는 것으로 하고 있으나, 일부 어선에 대해서는 예외규정을 두면서 이에 해당하는 어선원에 있어서의 안전상 공백을 고려하고 있지 못한 실정이다. 이에 따라 본 논문에서는 현재 시행 중인 어선원 관련 안전·보건 법제 등에 대한 전반적인 구성체계 및 그 세부내용 등에 대해 살펴보고, 이를 기반으로 어선원의 안전·보건을 유지·증진하기 위해 추가로 검토되어야 하는 사항을 중심으로 한 법제 정 비를 통해 현장에서 보다 안정적이고 실효성 있게 적용하기 위한 개선방안을 제시하고자 한다.
