At a time when it has become uncertain whether future generations will be able to enjoy the basic conditions of life that are as natural as air to the present generation, safeguarding sustainability has emerged as a pressing task of our era that seeks a balance and harmony among the economy, the society, and the environment. The 2022 revised national curriculum likewise sets as its goal enabling individuals, as citizens, to understand issues concerning human beings, society, the state, and the global community from an integrated perspective in order to lead sustainable lives. This study explores how the core value of ‘sustainable development’ presented in integrated social studies education is to be explained through relevant concepts and legal frameworks, and how it may be addressed from the perspective of human rights law education. First, it examines the formation of sustainability discourse and clarifies that coexistence and intra- and inter-generational equity constitute the normative core inherent in the concept of sustainability. It then analyzes the constitutional provision on the right to environment, individual environmental statutes, basic laws within specialized legal regimes, international treaties, and advisory opinions of international courts, thereby investigating how state obligations and transnational commitments for coexistence and sustainable development are legally articulated. Building on this, and drawing on the notion of emerging human rights and debates in Earth jurisprudence, this article suggests the possibility of a new rights-bearing subjectivity that moves beyond anthropocentric sustainability toward the coexistence of humans and non-human nature. In doing so, it argues that education of human rights law on sustainable development should go beyond the mere transmission of knowledge about relevant norms to critically examining the achievements and limitations of the existing legal framework within the trajectory of human rights that has historically extended rights to the ones previously deprived of rights, and to fostering sensitivity toward future generations and non-human entities.

현세대가 누리는 생의 기본 조건들을 다음 세대가 이어서 누릴 수 있을지 불투명해진 현시점에, 지속가능성의 보전은 경제-사회-생태의 균형과 조화를 추구하는 시대적 현안이 되었다. 현 사회과 교육과정에서도 개인⋅지역⋅국가⋅지구공동체 차원에서 우리 사회가 당면한 문제들을 이해하고 지속가능한 삶을 위해 노력할 것을 주요 목표로 제시한다. 본 연구는 고등 통합사회 교과의 핵심 내용 요소 중 하나인 ‘지속가능한 발전’을 인권법교육의 각도에서 어떠한 관련 개념들과 법률들, 그리고 인권 가치들과 연계하여 가르칠 수 있을지 탐색한다. 먼저 지속가능성 담론의 형성과정을 검토하고, 공존과 세대내ㆍ세대간 형평이 지속가능성 개념 에 내재한 규범적 핵심임을 밝힌다. 또한 우리 헌법의 환경권 규정과 개별 환경법, 전문법 체계의 관련 기본법, 국제조약 및 국제사법재판소 권고의견 등을 분석함으로써 공존과 지속가능한 발전을 위한 국가 의무와 초국가적 약속이 어떻게 법제화되어 왔는지 살핀다. 더 나아가 ‘생성 중인 인권’ 개념과 지구법학 논의를 인권법교육에 끌어옴으로써 인간중심의 지속가능한 삶을 넘어서 인간과 비인간 자연의 공존을 전제로 한 새로운 권리 주체성과 지속가능성을 학습자가 상상해갈 수 있음 을 제시한다. 이로써 지속가능한 발전에 대한 인권법교육은 권리 없는 존재들에 권리를 부여해 온 인권의 궤적 안에서 현행 법제의 성과와 한계를 논하고 미래세대와 비인간 존재에 대한 감수성을 함양하는 방향으로 구성되어야 함을 제안한다.
