Against the backdrop of growing distrust in the existing judicial system and the widening gap between legal judgment and public sentiment, private sanctions have become a subject of controversy regarding their legitimacy. Accordingly, this study utilized various text mining techniques on YouTube comments to analyze the public perception structure of private sanctions and to examine the formation processes of social emotions and reasoning that justify or criticize such actions. Furthermore, the study identified factors influencing these perceptions and categorized types of the public supporting private sanctions based on common patterns of responses. Ten news videos containing the keyword “vigilantism” were selected, and analyses including ‘Frequency analysis’, ‘TF-IDF’, ‘LDA Topic Modeling’, ‘Semantic Network analysis’, and ‘CONCOR analysis’ were conducted using R 4.4.3 and UCINET 3.0. The results revealed that, first, low trust in the judicial system and public authority was a major factor contributing to the emergence and spread of vigilantism. Distrust in formal sanctions creates gaps in institutional enforcement, which citizens fill through vigilante actions, a process that is further accelerated in online spaces. Second, public perceptions of vigilantism were classified into three types: (1) Vigilante critic, (2) Offender critic, (3) Distrust in the judicial system. Public evaluation was centered on two axes: (1) Severity of the act that prompted vigilantism and (2) Legitimacy of the vigilante act. Specifically, people assessed both the appropriateness of the act and the intent of the actor, and perceived legitimacy varied depending on whether the act was reasonably performed according to social and legal standards and whether the actor intended to enforce justice. The study contributes to the literature by empirically examining vivid public discourse on vigilantism, revealing social perception structures that previous studies have insufficiently addressed. Furthermore, public discourse in comments reflects broader societal sentiments toward the law and levels of trust in the judicial system, and judgments regarding the legitimacy of vigilantism are influenced by psychological, environmental, and cognitive factors in combination.

사법체계에 대한 불신과 법 감정의 괴리로 인해서 사회적 관심을 유발한 사적제재는, 국가나 공공 권력 및 법률에 의하지 않고 개인 또는 사적 단체가 범죄자에게 처벌을 가하는 행위로서, 그 정당성이 문제시되고 있다. 본 연구는 유튜브 댓글을 대상으로 다양한 텍스트 마이닝 기법을 활용하여 사적제재에 대한 대중의 인식 구조와 이를 정당화하거나 비판하는 사회적 정서 및 논리의 형성과정을 분석하였다. 나아가 이러한 인식에 영향을 미치는 요인을 규명하고, 공통적인 반응 양상을 바탕으로 사적제재를 지지하는 대중의 유형을 범주화하였다. 이를 위해 유튜브에서 ‘사적제재’ 키워드가 포함된 뉴스 영상 10편을 선정하고, R 4.4.3과 UCINET 3.0을 활용하여 단순빈도분석, TF-IDF 분석, LDA 토픽모델링, 의미연결망 분석, CONCOR 분석을 실시하였다. 분석 결과, 첫째, 우리나라 사법체계와 공권력에 대한 낮은 신뢰가 사적제재 를 발생ㆍ확산시키는 주요 배경으로 확인되었다. 공적제재에 대한 불신은 제도의 공백을 만들고, 이 공백을 시민의 사적제재가 메우는 구조를 형성하며, 이러한 과정은 온라인 공간을 통해 더욱 빠르게 강화되는 것으로 나타났다. 둘째, 사적제재에 대한 대중의 인식은 ‘사적제재자 비판형’, ‘범죄자 비난형’, ‘사법체계 불신형’의 세 유형으로 구분되었다. 대중의 판단 기준은 ‘사적제재를 유발한 행위의 심각성’과 ‘사적제재의 정당성’이라는 두 축을 중심으로 형성되었다. 구체적으로, 사람들은 사적제재 행위의 적절성과 행위자의 의도를 종합적으로 평가하였으며, 사적제재의 정당성은 행위가 사회적ㆍ법적 기준에서 합리적으로 수행되 었는지, 그리고 행위자가 ‘정의 구현’의 의도를 가졌는지 여부에 따라 달라졌다. 본 연구의 의의는 다음과 같다. 첫째, 사적제재에 대한 대중의 생생한 담론을 실증적으로 분석함으로써, 기존 연구에서 충분히 조명되지 못한 사회적 인식의 구조를 탐색하였다. 둘째, 댓글을 통한 대중의 담론은 사회 전반의 법 감정과 사법체 계에 대한 신뢰 수준을 반영할 수 있음을 보여주었다. 셋째, 사적제재의 정당성에 대한 대중의 판단에 심리적ㆍ환경적ㆍ인지적 요인이 종합적으로 작용하고 있음을 발견하였다.
