Police officer's duty execution law, Regulations on the use standards of hazardous police equipment are stipulated by the National Police Agency because it is the jurisdiction of the National Police Agency. The background of the enactment of the Maritime Security Act was enacted in consideration of the specificity of the Korea Coast Guard, but the standards for the use of equipment and equipment in the Enforcement Decree of the Maritime Security Act do not set all the standards for the use of the Korea Coast Guard, and it is difficult to say that the standards for the Korea Coast Guard are in place. The most desirable plan is to enact the Act on the Performance of Duties by Coast Guard Officers and to enact the Presidential Decree in accordance with the delegation of the Act. In other words, it is to establish independent standards of the Korea Coast guard without relying on the regulations of the National Police Agency on the use standards of hazardous police equipment. According to the principle of legal reservation derived from the principle of the rule of law administration, the standard of use for each equipment should be set in the law and the standard should be prepared in the enforcement ordinance. In the case of safety inspection standards and education and training standards, the National Police Agency stipulates in the Regulations on the Use Standards of Risk Police Equipment, and the Korea Coast Guard Equipment is stipulated in the Administrative Regulations of Weapons, Ammunition and Suppression Equipment. It does not fit. the Korea Coast Guard will also have to set standards at the presidential level.

불법조업 단속 장비 사용기준을 정한 ｢경찰관직무집행법｣, ｢위해성 경찰장비의 사 용기준 등에 관한 규정｣은 경찰청의 소관법령이므로 경찰청의 입장에서 규정한 것이 다. 또한 ｢해양경비법 시행령｣의 장비 및 장구 사용기준이 최적의 기준이라고 보기 어렵다. 가장 바람직한 방안은 ｢해양경찰관직무집행법｣을 제정하고, 그 법률의 위임 에 따라 대통령령을 제정하는 것이다. 그 법령명은 ｢해상에서의 위해성 경찰장비 사 용기준 등에 관한 규정｣이라고 명명할 수 있을 것이며, 해양경찰의 독자적인 기준을 마련하는 것이다. 장비별 사용기준에는 중국어선 선원의 사망사례가 있는 40mm다목적발사기의 사 용기준이 명확히 규정되어야 하고, 12게이지 비살상탄 발사기, 섬광 폭음탄, ㅏ자봉, 함정 소화포, 단정 소화포, 최루액 분사기, 유압콤비 절단기 등의 사용기준이 법치행 정의 원리에서 파생한 법률유보의 원칙에 따라 법에서 한도를 정하고 시행령에서 그 기준을 마련해야 할 것이다. 장비에 대한 안전검사 기준과 교육훈련 기준의 경우 훈 령인 ｢무기·탄약 및 진압장비 등 관리규칙｣에서 규정하는 것이 아니라 대통령령 수 준에서 기준을 정해야 할 것이다.
