Purpose : This paper examines whether firms in arbitration have an incentive to become the first mover when they can strategically delegate tasks to their lawyers. Research design, data, methodology : The study employs a two-stage game model where firms first set a lawyer's incentive scheme based on relative performance. Lawyers then choose an effort level that determines the arbitration outcome, with their pay tied to the performance difference. Results : The findings indicate that simultaneous moves result in zero profits for both firms. However, in a sequential game, the first mover secures a positive profit while the follower incurs an equivalent loss, an advantage gained by strategically committing to an effort level first. Conclusions : The study shows that firms possess a strong incentive to gain first-mover status, which can trigger pre-hearing procedural competition. This has significant implications for the design of arbitration rules and suggests avenues for future research.

본 논문은 변호사에 대한 전략적 위임이 가능한 중재 상황에서, 기업이 먼저 행동하는 선발자 (first mover)가 될 유인이 있는지 분석한다. 연구 방법론으로는 2단계 게임 이론 모형을 사용하 였으며, 첫 단계에서 기업이 변호사의 상대적 성과에 연동된 인센티브를 설계하고, 다음 단계 에서 변호사가 중재 결과에 영향을 미치는 노력 수준을 결정한다. 국제중재 제도는 절차적 자 율성이 높아 서면 제출이나 변론 순서 등 절차 설계가 기업 간 유불리에 실질적 차이를 초래할 수 있다. 분석 결과, 두 기업이 동시에 행동할 경우 양측 모두 이윤이 0이 되는 반면, 순차적으 로 행동할 경우에는 선발자가 명백한 양(+)의 이윤을 확보하고 후발자는 그만큼의 손실을 보 는 것으로 나타났다. 이러한 선발자 우위는 자신의 노력 수준을 먼저 확약하여 상대방의 반응 을 유리하게 유도하는 전략적 위임의 핵심 메커니즘에서 비롯된다. 본 연구 결과는 기업이 중 재 과정에서 선발자 지위를 차지하기 위해 심리 이전 단계부터 절차적 경쟁을 벌일 강력한 동기가 있음을 시사하며, 이는 절차적 공정성과 효율성의 균형을 고려한 중재 제도 설계에 중 요한 함의를 제공한다.
