This study examines the legal issues surrounding small UAV flight in the airspace above national major infrastructure, focusing on the limitations of the current legal framework and proposing directions for improvement. As s-UAV usage expands rapidly across military, industrial, and commercial sectors, unauthorized UAV flights near sensitive facilities increasingly raise concerns regarding national security and public safety. Therefore, the establishment of clear legal regulations governing such airspace has become an urgent necessity. Through an analysis of existing laws and regulations, including the Aviation Safety Act, this paper identifies key legal and regulatory gaps concerning airspace designation, operational approval procedures, and enforcement measures. The study highlights the need to clarify the legal definitions of protected airspace, establish detailed operational standards, and implement both technical and institutional monitoring systems. Ultimately, this paper aims to balance the freedom of UAV flight with the imperative of national security, and to suggest legal and policy directions that support the safe and lawful use of airspace around national major infrastructure. The findings may serve as a foundational reference for future legislation and policymaking in this evolving field.
