The purpose of this study is to revise the local government laws and promote the protection of teachers’ rights by comparing the Teachers’ Rights Protection Act and the Autonomous Laws between local governments. The subjects of the study are the Teachers’ Rights Protection Act and the local government laws of 17 local governments nationwide. The analysis results are as follows. All 17 local governments nationwide have enacted ordinances for teaching authority and educational acts. In addition, local governments’ laws were divided into “Teachers’ Rights and Education Activities,” “Teachers’ Rights Protection Committee Rules,” and “Legal Support Group Rules,” and there were still local governments that did not enact rules. However, it was difficult to protect school rights in the event of infringement of educational activities because the contents of self-government laws were not specific and were made of discretionary regulations rather than mandatory regulations. The purpose of analyzing the comparison of local government laws is to reduce infringement of educational activities and to support teachers. Accordingly, it would be desirable to reflect the recently revised Teachers’ Rights Protection Act in autonomous regulations, provide sufficient information to teachers, and to implement education to prevent teachers’ rights protection by external professional organizations such as research institutes and academic societies related to law, human rights, and education.

본 연구는 교권보호법과 자치법규를 지방자치단체 간 비교분석함으로써 교권보호 자치법규를 개정하고 궁극적으로 교권보호증진을 목적으로 하고 있다. 이에 연구의 분석대상은 교권보호와 관 련된 법들과 전국 17개 지방자치단체의 자치법규이다. 분석결과 전국 17개 지방자치단체 모두 교권과 교육활동 조례를 제정하였고, 2023년 이후 현 재까지 상당한 법령이 개정되었다. 교권보호와 관련된 지방자치단체의 자치법규는 “교권과 교육활 동 조례”, “교권보호위원회 규칙”, “법률지원단 규칙”으로 구분되는데, 아직도 규칙을 제정하지 않 은 지방자치단체가 존재하는 것으로 나타났다. 게다가 기존의 조례와 규칙을 제정한 지방자치단체 의 자치법규 조항들에서도 교권을 지원하는 내용이 구체적이지 못하는 경우도 상당하였고, 강행규 정이 아닌 임의규정으로 규율되어 있어 교육활동 침해 발생시 교권구제에 어려움이 있는 것으로 분석되었다. 지방자치단체의 자치법규 비교를 분석하는 것은 교원들의 수업이나 교육활동 침해를 감소하고, 침해를 경험한 교원들에게는 상담 등 지원방안을 모색하는 것이다. 이에 최근 개정된 교권보호법 을 자치법규에 반영하도록 하고, 교원들로 하여금 충분한 정보를 제공하며, 법ㆍ인권ㆍ교육 관련 연구소나 학회 등 외부전문단체로 하여금 교권보호 예방 교육 시행이 바람직할 것이다.
