Traditionally, alternative claims in civil litigation were permitted only when the claims were mutually exclusive. However, Korean Supreme Court precedents have long accepted “non-genuine alternative claims,” where compatible claims are combined in the alternative. As a result, the requirement of mutual exclusiveness has lost its significance. This paper argues that the legality of alternative claims, as a form of conditional pleading, can be sufficiently ensured through the requirement of relevance alone, rendering the mutual exclusiveness requirement obsolete. While mainstream jurisprudence treats non-genuine alternative claims in the same manner as genuine alternative claims, it inconsistently applies different reasoning in appellate review. Specifically, courts have held that the nature of the claims, not the parties’ intent, should determine the form of combination—treating them like optional claims. This approach lacks coherence. If non-genuine alternative claims are to be recognized, the procedural rules for alternative pleading should be consistently applied. The determination of the form of joinder of claims is not a matter to be resolved by choosing between the “theory of legal nature” or the “theory of party intention” (or even a “compromise theory” between the two). Rather, it depends on whether the specific requirements for each form of joinder are satisfied. If the requirements are not met, the chosen form of joinder cannot be recognized, regardless of the parties’ intention. Conversely, within the scope where such requirements are satisfied (i.e., where the permissible ranges of different forms of joinder overlap), the principle of party disposition requires that the joinder of claims be determined in accordance with the parties’ expressed intention. The abolition of the mutual exclusiveness requirement would make alternative combination possible in all cases where optional combination is allowed. Given the problems of claim indeterminacy and potential violations of party disposition principles inherent in optional combination, this paper ultimately suggests that the optional combination should be abolished and integrated into the alternative claim system.

전통적으로 예비적 청구병합은 양립 불가능한 청구들 사이에서만 인정되어 왔으나, 판례가 오래전부터 ‘부진정 예비적 청구병합’, 즉 양립 가능한 청구의 예비적 병합을 허용해 옴으로써 ‘양립불가능성’ 요건은 그 의미를 상실하였다. 조건부 청구로서의 예비적 청구의 적법성 문제 는 ‘관련성’ 요건만으로도 충분히 해결될 수 있으므로 ‘양립불가능성’ 요건은 폐지하는 것이 타당하다. 주류적인 판례는 부진정 예비적 청구병합을 진정 예비적 청구병합과 동일하게 취급하고 있으나, 유독 ‘상소심의 심판범위’에 관해서만 ‘청구병합의 형태는 당사자의 의사가 아니라 병합청구의 성질을 기준으로 판단하여야 한다’는 논리를 내세워 선택적 병합처럼 취급하고 있다. 그러나 부진정 예비적 청구병합을 인정하는 이상 그에는 일관되게 예비적 병합의 심판 방법이 적용되어야 한다. 청구병합 형태를 결정하는 것은 ‘성질설’ 또는 ‘의사설’ (혹은 그 사이의 ‘절충설’) 중에 어느 하나를 선택하여 해결할 문제가 아니다. 각 청구병합 형태별 요건을 따져서 그 요건을 충족하 지 못하면 당사자의 의사에도 불구하고 해당 청구병합 형태로 인정할 수 없는 것이고, 반대로 그 요건을 충족하는 범위에서는(즉 청구병합 종류별 허용범위가 겹치는 영역에서는) 처분권 주의에 따라 당사자가 정한 청구병합 형태에 따라야 한다. 예비적 병합의 ‘양립불가능성’ 요건을 폐지할 경우 선택적 병합이 가능한 사안은 언제나 예비적 병합도 가능하게 된다. 선택적 병합은 청구 불특정 및 처분권주의 위반의 문제가 있으 므로, 장기적으로는 이를 폐지하고 예비적 병합으로 통합하는 것이 바람직하다.
