After World War II, Japan classified Zainichi Koreans as aliens, subjecting them to the utmost discretion of Japanese immigration authorities. Drawing insight from Song Tu-hoe’s lawsuit, this article conceptualizes the violence that shaped Zainichi Koreans’ alien status. Raised as an adopted son of a Japanese monk and having spent his youth in Manchuria, Song identified himself more as Japanese than Korean. Beginning in 1969, he challenged the state violence that had unilaterally revoked his Japanese nationality, compelling him to live as an alien in post-1945 Japan. His struggle resonated with the experiences of Sakhalin Koreans, who were stranded on the island after forced labor during the wartime, as well as that of a Taiwanese exile who appealed to his former Japanese nationality to avoid deportation. Focusing on the term “martial law,” which was used to conceptualize their postcolonial condition, this article addresses the power that shaped their statelessness in the post-1945 period. What Song and other former colonial subjects encountered in postwar Japan can be characterized as the politics of ‘inclusive exclusion.’ It means the situation in which, through the non-application of the Japanese nation-state’s newly established legal order, they were placed under the discretionary state power of alien control. This article conceptualizes the postcolonial lives of Zainichi Koreans as a mode of existence marked by an indispensable exception to the emergence of a new legal order: postwar Japan’s nation-state and democratic system. What enabled this postcolonial relationship between Japan and Zainichi Koreans can be framed as an issue of sovereign violence.

1945년 이후 일본은 재일조선인을 외국인으로 분류하여, 각종 시민적 권리로부터 배제하는 한편 임시적으로 일본에 거주하는 존재로 만들었다. 이 글은 1969년 송두회가 시작한 일본 국적 확인 소송에 주목하여, 무국적자에 가까운 상황을 식민지 출신자에게 강요한 폭력의 개념화를 시도한다. 일본 승려의 양자로 자라 청년기를 만주에서 보낸 송두회는 조선인이라기보다는 일본인에 가까운 감각으로 살았다. 그런 그를 외국인으로 취급하는 일본 국가의 폭력에 대해 송두회는 일본 국적을 확인한다는 방법으로 맞섰다. 재일조선인 1세의 민족 정체성이나 2세의 반차별 투쟁 어느 쪽과도 구별되는 송두회의 입장은 마찬가지로 식민지 출신자로서 일본 국적을 방법적으로 활용한다는 맥락에서 사할린 잔류 조선인이나 타이완인 망명자의 처지와 공명했다. 이들의 공동투쟁 과정에서 제기된 ‘계엄령’이라는 단어는 전후 일본에서 재일이라는 삶을 생성하고 규정하는 권력을 해석하기 위한 실마리를 제공한다. 송두회를 비롯한 식민지 출신자가 전후 일본에서 경험한 것은 국민국가로 재편된 일본에서 법질서의 비적용을 통해 출입국관리 권력이 휘두르는 재량권 아래에서 포섭적으로 배제된 삶이다. 재일‘외국인’이 된 그들에게 적용되는 법 바깥의 삶을 출현시키는 힘이란 주권적 폭력에 해당하는 문제였다. 이런 시각에서 볼 때, 재일이란 전후 일본의 국민국가와 민주주의라는 새로운 법질서의 출현에 불가결한 예외 속에 놓인 삶이라고 할 수 있다.

서울대학교 일본연구소는 체계적이고 종합적인 일본 연구를 통하여 동아시아의 평화와 번영에 기여하는 것을 목적으로 2004년11월19일 설립되었다. 본 연구소는 서울대학교에서 일본지역학의 교육ㆍ연구 체제를 갖춘 국제대학원이 주관하며, 서울대학교의 다양한 학문 분야의 일본 관련 연구를 하고 있는 교수, 연구자들이 모두 참여하여 운영된다.
일본관련 자료의 수집과 정리, 정보네트워크 구축, 연구활동 지원, 대외적인 학술ㆍ인물 교류 등 일본연구의 기반을 조성하기 위한 그간의 실적을 토대로 하여 새롭게 출범한 서울대학교 일본연구소는 오늘날 국내외 정세의 변화를 배경으로 일본연구의 새로운 방향을 모색할 것이다. 이를 통하여 한국의 일본 연구 및 교육의 발전에 기여할 뿐 아니라, 국제사회에서 일본연구의 새로운 틀을 창출하는 데 적극적인 역할을 수행하고자 한다.
